Legal Issues in Permitting Dual Nationality

우리 국적법은 속인주의와 함께 단일국적주의, 즉, 이중국적의 금지를 한 핵심요소로 하고 있다. 그런데, 이러한 이중국적 금지에 대해, 세계화 조류에의 부합이라든지 이중국적 허용이 가져다줄 여러 편익 등을 이유로 이를 폐지하고 이중국적을 자유롭게 허용하자는 주장들이 몇 년 전부터 꾸준히 제기되어 왔고, 최근 이명박 대통령이 미국 교포사회에 가서 해외동포들에 대한 이중국적 허용 추진을 언급하면서 이중국적 허용의 주장과 논의들이 더 활발히 개진되고 있다. 현 시점에서 이중국적 허용과 관련된 여러 법적 쟁점들을 검토해보고, 이중국적을 허용한다면 어떤 준비를 해서 어떤 방식으로 이를 추진하는 것이 바람직한가를 규명하는 것이 본 연구의 목적이다. 이를 위해 우선 이중국적의 의의 및 발생 원인과 이중국적 관련 국내외 법제들을 살펴보고, 이중국적 허용의 문제를 2005년의 국적법 제12조 개정 이전과 이후로 나누어 검토해본다. 소위 ‘홍준표 법안’의 국회 통과로 이루어진 2005년의 국적법 제12조 개정은 사실상 이중국적이나 이중국적 취득 후 외국국적의 선택을 병역의무 회피의 수단으로 사용할 수 없게끔 만든 중요한 법제 변경을 가져온 사건이기 때문이다. 물론 이 대목에서 2005년 국적법 제12조 개정안의 내용 및 국회 통과의 과정도 면밀히 분석해본다. 그리고 이러한 검토와 분석에 근거해 이중국적 허용시 그 바람직한 접근 및 추진방법에 대해 고민해 보며 국민정서를 고려한 단계적인 이중국적 허용 범위 확대가 왜 필요한지도 생각해본다.

Nationality Act in Korea provides the prohibition of dual nationality as an important factor. As for the prohibition of dual nationality, there have been many proposals permitting the dual nationality in terms of the globalized international environment since couple of years ago. In addition, President Myong-bak Lee's speech to Korean Society in the United States which implied that Korean government had the plan to permit dual nationality for Korean-Americans brought fierce controversies in Korea. The aim of this study is to examine the various legal issues in permitting dual nationality and to explore the desirable preparations and approaches in permitting dual nationality if we decide to adopt it. For these, this paper will examine the meaning of dual nationality and current domestic legal systems on dual nationality as well as foreign ones. And then, I will inquire into the issue of permitting dual nationality before and after the revision of Article 12 of Nationality Act in the year of 2005. That is because the revision of Article 12 of Nationality Act actually banned Korean people with dual nationality from using the dual nationality as a means to evade the compulsory military service. In this part, this paper will also closely examine the contents of the bill as well as the processes for this bill to pass the Korean National Assembly. Finally, based on the results of the study above, the paper explores the desirable approaches and promoting methods of permitting dual nationality.
