공직선거시 낙선운동에 대한 헌법적 평가

선거의 자유와 선거의 공정성 보장은 상호 갈등관계를 유발할 수 있다. 따라서 공선법은 선거의 자유를 침해하지 않는 한도에서 선거의 공정성을 유지할 수 있는 제도를 강구해야 하며, 필요최소성의 한계를 준수해야 한다. 공직선거법상 선거운동의 개념을 ‘당선 또는 낙선하게 하기 위한 행위’로 넓게 규정한 것은 선거운동과 관련한 자의적인 처벌이 가능하므로 죄형법정주의의 파생원칙인 명확성의 원칙에 위배될 가능성이 높다. 공선법상 ‘선거운동’의 개념과 ‘선거에 관한 단순한 의견의 개진이나 의사의 표시’ 내지 ‘정당의 후보자 추천에 관한 단순한 지지·반대의 의견개진 및 의사표시’간의 구별이 쉽지 않고, 양자간 구별의 판단을 집행기관에 그 해석권한을 포괄적으로 위임하고 있어 헌법상 ‘포괄위임금지원칙’에 위배되기 쉽다. 낙선운동과 관련된 사건에서 헌법재판소는 주로 정당과 일반단체의 차이와 시민단체의 활동에 대한 역기능에 대해서만 논의를 집중시키고 있다. 그러나 헌법재판소 판결에서 본질적인 쟁점으로서 헌법상 각 기본권이 침해되었는지 여부를 판단했어야 했다. 또한 낙선운동을 위한 전제조건으로 정당의 당내민주주의가 정착되어야 하며, 공직후보자의 프라이버시권보다 국민의 알 권리의 우선적 보장이 인정되어야 하고, 시민단체의 신뢰성과 공정성이 확보되어야 한다.

The negative campaigns against unfit candidates in the election is causing a great repercussion over the political field. Section 58 (1) of the election law prohibit the Citizens’ Coalition for the general election from conducting negative campaigns against unfit candidates. the Citizens’ Coalition claimed that the election law which bans civic organization from publicly expressing opinions regarding election was an infringement of fundamental rights. The Constitutional Court concluded that the Section 58 (1) of the election law, which ban on negative campaigns against unfit candidates could meet constitutional criteria. The Constitutional Court then announced that there is no difference between the negative campaigns and the positive campaigns. If the election law has its exceptions and the law permits of all negative campaigns of the Citizens’ Coalition, it violates the fairness of the election system. But Section 58 (1) of the election law violates clearness doctrine and infringes right of expression in Art. 21 KV, which protect freedom of speech and assembly. In sum, Section 58 (1) of the election law does pose such inherent dangers to free expression and suffrage.
