지적측량대가(代價)에 관한 고찰

A study on the cost of the cadastral survey

본 연구는 지적측량의 대가(代價)를 분석하고, 이를 토대로 지적측량의 대가(代價)에 대한 개념을 정립하는데 목적이 있다. 연구내용은 지적법상 측량과 측량법상 측량, 지적법상 측량의 대가(代價)와 측량법상 측량의 대가(代價)의 개념을 분석하여 지적측량에서의 수수료의 개념의 타당성을 정립하는 것으로 하였다. 연구결과 지적측량사무는 국가의 중요한 책무 중의 하나이므로 국가가 공공기관이나 민간지적측량업자에게 위임 또는 위탁하여도 국가사무이며, 지적측량은 위탁받은 공공기관이나 민간지적측량업자가 그 사무처리로 인한 비용을 받는 것이므로 그 대가(代價)는 수수료로 봄이 당연하다.

The purposes of this study are not only to analyze the cost of the cadastral survey but also to build fundamental notions according to the result. Above all, I have researched the difference between the survey under cadastral act and under surveying laws, and I have conducted a study on the feasibility of the service charge(commission) of doing the cadastral survey by analyzing the difference between the cost of the survey under the cadastral act and the cost of the survey under the surveying law. As a result, I think the work of the cadastral survey is an important national duty, so the government may consign or authorize the matter of cadastral survey to public organizations or private surveyors. Because there is considerable expense associated with the cadastral survey, it is natural that the authorized public organizations or private surveyors incur the cost.
