SWIFT신용장에서의 부가조건에 관한 사례연구

A Case Study on Additional Conditions under SWIFT Letter of Credits

SWIFT신용장(MT700/701)의 Field가 2007년부터 추가되거나 약간 수정되어 사용되고 있다. 특히 40E의 Applicable Rule이 신설되면서 모든 신용장에 적용규칙을 명시되도록 하였다. 이와 같이 SWIFT신용장의 포맷의 변경에 맞추어 화환신용장통일규칙(Uniform Customs and Practice for Documentary Credits : UCP)도 6차 개정되면서 그 동안의 신용장관행을 대폭 수용하려고 시도하였다. 본 논문은 기존의 연구와 달리 은행 현장에서 사용되고 있는 신용장을 수집하여 사례를 분석할 가치가 있다고 판단되어 시도한 것이다. 특히 본 연구는 SWIFT신용장의 부가조건(47A)과 지급·인수·매입은행에 대한 발행은행의 지시사항(78)에 기재된 사례에 국한하여 분석을 시도하고자 한다. 연구의 목적은 SWIFT 신용장의 부가조건과 관련된 사례를 분석하여 실무관행상의 문제점을 파악하고 이에 대한 시사점과 함의를 제시하는데 있다.

Field Name of SWIFT L/Cs(MT700/701) is modified from 2007. In business operations relating to L/Cs, that is the issuance, amendment of letter of credits, SWIFT systems are used in a large extent. In connection with SWIFT L/Cs Usage, some problems exist such as an infringement of L/Cs nature, some articles exception of UCP 600, violation of independent rule, additional fee and surrender B/L. Research methodology of this paper analyzed documentary credits of 148 samples which are used in commercial banks. Studied contents are additional conditions of 47A and instructions to the paying/accepting/negotiating bank(78). The purpose of this study is to provide some important problems and implications of DC transaction Usage in Korea trade companies.
