컴퓨터․전자통신기술의 급속한 발전은 새로운 유형의 전자상거래의 확장을 초래하였다. 사이버공간에서의 거래는 오프라인 거래와 마찬가지로 많은 문제와 분쟁을 유발시킨다. ADR의 경우 스피드, 비용, 공개네트워크 시스템의 특성을 가진 온라인 거래에는 적합하지 않는다. 급격한 변화로 말미암아 오프라인에 중심을 두고 발전되어온 기존의 소송만으로 복잡 다양해진 온라인상의 분쟁을 해결하기에는 다소 어려운 것이 현실이다. 또한 기존의 소송방식에 의해 온라인상의 분쟁을 해결하려 할 경우, 전자거래를 통해 얻고자 했던 경제성과 신속성이 오히려 더 큰 손해와 시간상의 낭비를 초래할 수도 있다. 따라서 전자거래를 통한 경제성과 신속성을 확보한 상태로 분쟁을 해결할 수 있는 절차의 필요성이 생겨나게 되었다. 본 논문에서는 전자상거래에서 발생하는 다양한 분쟁을 해결하는 온라인 ADR의 실제 운영상태 및 문제점에 대해 고찰한다.

Rapid development of computer and telecommunication technology brought out the expansion of electronic commerce which is the new type of business transaction. Offline transaction can lead to problems and disputes the same is for cyberspace transactions. However ADR is not meet for the online transaction for speed, cost and open network system, ADR has some advantages that are convenience, Low-Cost, Legitimate to Online Users and Avoids Jurisdiction Issues and some disadvantages that are loss of the human factor, lack of accessibility, lack of confidentiality and security and difficulty of enforcing arbitral agreements. But these disadvantages will be able to overcome with development of technology and changing a way of thinking. This study is an attempt to investigate the actual operation conditions and the problems in relation to ADR, which is for settlement of e-disputes rising from the electronic commerce
