UNCITRAL 계약협약상 전자계약의 성립에 관한 연구

A Study on the Conclusion of the Electronic Contract under the UNCITRAL Contracts Convention

정보기술의 발달과 함께 전자 무역 또는 국제전자상거래의 규모가 급속히 증가하고 있다. 그러나 국제 전자거래의 원활화에 많은 문제 및 장애요인이 등장하고 있으며 특히 전자 메시지 전달과정에서 발생하고 있다. 이러한 문제를 해결하기 위해, UNCITRAL은 전자계약협약이 제정되었다. 본 연구는 UN 전자계약협약상의 전자계약성립에 관해 살펴봄으로써 전자계약협약상의 법리의 이해를 증진시키는 데 연구의 목적이 있다.

With development of information technology, the volume of electronic trade and international electronic commerce have increased sharply. However a number of problems and obstacles to international commercial transaction were taken place particularly in transferring electronic message. To resolve theses problems, the UNCITRAL has enacted ｢United National Convention of Electronic Communications in International Contract｣. Accordingly, this paper attempts to explore the conclusion of the electronic trade contract under UN convention on the use of electronic communications in international contract.
