온라인분쟁해결(ODR)을 통한 분쟁해결상의 문제점과 활성화 방안에 대한 연구

A Study on the Problems and Solutions of Dispute Resolution through ODR

온라인상에서의 상거래활동은 오프라인 상거래와 다르기 때문에 새로운 형태의 분쟁과 문제를 유발시킨다. 오프라인을 중심으로 되어 있는 기존의 분쟁해결제도만으로 복잡 다양해진 분쟁을 해결하기에는 다소 어려운 것이 현실이다. 그러므로 인터넷과 컴퓨터 네트워크를 이용한 온라인분쟁해결(ODR)이 등장하게 되었고, 인터넷 사이트들을 이용한 분쟁해결에 일익을 담당하고 있다. 본 논문에서는 국내․외 ODR의 동향을 다루고 실제 운영되고 있는 ODR서비스기관이 또한 소개된다. 본 논문의 목적은 ODR시스템의 문제점과 해결방안을 연구함으로써 글로벌 ODR의 활성화에 기여하는 것이다.

On-line e-commerce causes new kinds of disputes and problems owing to being different with off-line commerce. It is difficult to resolve the complicated and various disputes in international commerce only using existing ADR which is based on off-line. Therefore ODR using internet and computer network was introduced and plays an important role in the disputes resolution using internet website. This paper describes ODR’s trend at home and abroad and existing ODR service organizations are introduced as well. The purpose of this paper is to contribute to the activation of ODR globally by studying the problems and solutions in ODR systems.
