전자무역 단일창구를 통한 전자선화증권의 권리이전에 관한 고찰

Transfer of Right of the Electronic Bill of Lading through the Electronic Trade Single Window

정보통신기술의 발전은 국제무역거래활동에 영향을 미쳤기 때문에 전통적 종이문서 기반의 무역관행을 대신하여 데이터 메시지로서의 전자문서 기반의 무역관행을 개발하고 사용하기 위한 시도가 많이 있었다. 선화증권은 권리증권으로서 기능을 가지고 있기 때문에 선화증권은 주요한 무역문서 중의 하나이다. 따라서 그 기능을 종이기반에서 전자적인 것으로 전환하는 것은 국제무역업계의 주요한 이슈중의 하나이다. 본 논문의 연구목적은 선화증권을 전자선화증권으로 전환에서의 문제점들을 검토하고 싱글윈도우 방식에 의한 전자선화증권의 권리양도와 유통성을 달성하기 위한 체계를 제공함으로써 전자선화증권의 활성화에 기여하는 것이다.

As information and communication technology has made an impact on the way of cross-border trade practice, there are many attempts to develop and use electronic trade documents as data message instead of traditional paper documents. Bill of Lading is one of the main trade papers because it has the function of document of title, changing the function from paper based one to electronic one is major issue of the international trade community. The purpose of this paper is to contribute to activate electronic bill of lading by investigating the problems in the conversion of bill of lading to electronic alternative one, and proposing scheme to achieve the transfer of right and negotiability of the Electronic Bill of Lading by Single Window method.
