Legitimacy on the Establishment of Constitution

헌법제정의 정당성에 관한 연구는 시예스에 의하여 주장되기 시작하여 슈미트에 의하여 완성된 것처럼 소개되고 있다. 그리고 그들의 논의가 전부인 것처럼 지금도 거론되고 있다. 그러나 헌법제정의 정당성의 문제는 과거의 문제가 아니라 오늘의 문제이어야 한다. 현재의 정당성이론을 토대로 과거와 현재의 헌법제정의 정당성을 평가해야 한다는 것이다. 20세기에는 전통적 정당성과 합리적 정당성이라는 대립관계를 통하여 정당성이론이 전개되었다. 예를 들면 전통적 정당성과 합리적 정당성의 문제가 그것이다. 그러나 21세기에 들어서는 정당성이론이 합치된 방향으로 설명된다. 통합된 국가기능을 토대로 국가통치와 관련된 모든 정당성이론이 3가지 방향으로 통합되어 정리되고 있다. 민주적 정당성, 절차적 정당성, 목적적 정당성이 그것이다. 결국 이 연구의 목적은 헌법제정의 과정에서 적용되어야 할 3가지 정당성원리의 구체적 내용을 제시하는데 있다. 왜냐하면 헌법제정의 정당성이 이 3가지 정당성원리에 의하여 평가되어야 한다고 보기 때문이다. 또한 우리 헌정사를 연구함에 있어서 그것을 기준틀로 삼아 연구하는 것이 중요하다고 생각하기 때문이다.

Most of the Korean Professors think that the principle on the legitimacy of the establishment of constitution is introduced by A. V. Sieyes and accomplished by K. Schmitt. And those two scholar's opinions are all on the issue of the legitimacy of the establishment of constitution. But the legitimacy of the establishment of constitution should be the problem of today, not of the past. The legitimacy of the establishment of constitution has to be estimated by the recent principle of legitimacy. Until the 20th century, human history developed the principles of legitimation through the friction of two opposing values, for example, the friction between the traditional legitimacy and rational legitimacy. However, we notice that these opposing principles of legitimacy were amalgamated in the 21th century. And we may amplify this principle into the following three subcategories: democratic legitimacy, procedural legitimacy, and objective legitimacy. Therefore, the objective of this study is to suggest the concrete contents of these three principles of legitimacy in the course of the establishment of constitution. Since the legitimacy of the establishment of constitution should be evaluated by these three principles of legitimacy. Also, when we study Korean Constitutional History, it is important to apply these three principles of legitimacy.
