The Current Status and the Prospects of the Legal System of the International Logistics of China in the Era of E-Commerce

점점 더 많은 산업들이 전자상거래의 영역에 발을 들여놓고 있다. 물류산업은 전통적인 모델에서 현대적인 모델로의 급격한 변환기를 겪고 있을 뿐만 아니라 전례 없이 많은 중요성이 부여되었으며 또한 물류분야는 전자상거래의 발전에 있어 굉장히 의미 있는 역할을 수행하여 왔다. 물류대상 법률체계와 물류행위 법률체계의 관점에서 전자상거래 환경 하에서 현대물류의 국제화 진전경향과 현대물류의 새로운 특성에 유의하였다. 하지만 전체적으로 중국에서의 법률제정과 관련된 부서는 현대물류의 전자상거래화의 중요성을 충분히 인지하지 못하고 있다. 따라서 본고는 중국 현대 물류의 입법 현황을 분석하고 현대 물류의 특성과 중국의 현황과 관련된 중국 물류의 법칙 체계의 발전에 대한 전망을 하고자 한다.

The logistics industry not only has achieved the rapid transition from the traditional model to the modern model but also has been attached on much unprecedented importance. The logistics has been the significant power which supports the further development of e-commerce. At the aspects of the logistics subject legal system and the logistics action legal system. There is the internationalization development trend of the modern logistics and the new characteristics of the modern logistics under the e-commerce environment. As a whole, the legislature and the correlative departments of China do not attach enough importance on the e-commercialization of the modern logistics. The paper analyzes the legislative status quo of the modern logistics of China and the paper makes an outlook about the development of the China's logistics legal system combining with the characteristics of modern logistics and the domestic situation.
