국군부대의 소말리아 해역파병 특례법에 관한 연구

A Study on the Proposed Special Act for Anti-Piracy Activities in Somali Waters

해적행위는 수천 년의 역사를 가지고 있으며 쉽게 근절되지 않는 범죄 중의 하나이다. 최근 소말리아에 무정부 상태가 지속됨에 따라 해상교통의 요충지인 이 해역에서 해적행위가 급증하고 있다. 이에 따라 세계 각국은 해적으로부터 해상교통의 안전을 도모하기 위하여 이 해역에 군함을 파견하고 있다. 2009년 3월 우리나라의 해군함정도 해적방지활동을 위하여 진해항을 출항하였다. 이 해군함정은 현지에서 대한민국 선박에 대한 호위활동을 하는 한편, 외국 선박이 해적으로부터 공격받을 경우 해적을 격퇴하는 업무를 수행할 예정이다. 법의 지배라는 원칙에서 볼 때 해군함정이 소말리아 해역에서 해적방지활동을 할 경우라도 그러한 공권력의 행사는 엄격한 대한민국 법률의 통제를 받아야 한다. 그러나 우리의 해군함정은 출항했지만 그들의 원활한 작전을 위한 법률의 정비는 아직 이루어지지 아니한 상태에 있다. 이에 따라 예컨대 해적을 체포하더라도 우리나라 법률에서는 이들을 처벌할 규정이 없다. 또 해적선을 나포할 경우 이는 국유재산이 되나 국유재산법에 정하는 엄격한 절차를 따를 경우 함정의 원활한 작전수행에 상당한 지장을 받을 수 있다. 이러한 관점에서 이 논문에서는 해적죄의 신설, 해군함장에 대한 사법경찰관의 임명, 체포된 해적의 사법처리절차, 나포된 선박에 대한 간이한 처리 등 해군함정의 해적방지활동을 지원하기 위한 특례법의 제정을 제안하고 있다.

Piracy is one of the oldest crimes that are hard to eliminate. In recent years, the number of piracy has increased dramatically in Somali waters, largely thanks to the armed conflicts in Somalia. To secure the safety of maritime traffic, many countries have sent warships to Gulf of Aden, which is connected to Suez Canal, one of the choke points in the World. In March, 2009, a Korean warship departed Jinhae, Korea to Somalia to join forces with other navies. There, the Korean navy is expected to escort Korean vessels passing Somali waters and to protect foreign vessels under pirate's attack. Under the principle of rule of law, public officers including navy officers should be accountable: they should abide by the Korean law. Unfortunately, an appropriate law for the warship in Somali waters has not been enacted in the National Assembly. Without it, the naval anti-piracy activities would be severely restricted. For example, captured pirates could not be punished due to the lack of legislation. Further, under the strict Korean National Asset Act, seized pirate ships would not be abandoned. In this respect, the author assess the current anti-piracy systems, both Korean and international ones, respectively. Finally, the author proposes a Special Act for Anti-Piracy Activities in Somali Waters, taking into account various considerations.
