성(폭력)범죄의 실태와 대책

인류 역사가 시작된 이래 성폭력 범죄는 끊임없이 발생하였고 여성들은 성범죄의 피해자로 시달려왔다. 성폭력 범죄는 피해자 개인과 친족 및 사회에 정신적, 물질적 손실을 가져오며 피해자의 일생을 계속 고통에서 보내게 할 수 있다는 점에서 강력 범죄 중의 하나이다. 따라서 성범죄에 대한 막연한 불안과 조심만으로는 성범죄를 피할 수 없다는 현실을 인식하고, 성범죄로부터 자유롭고 인간적인 삶을 살아가기 위하여 형법과 성특별법에 규정된 성범죄의 실태와 해석 및 판례를 중심으로 본 논문을 기술한다.

Sexual assault has arised endlessly and women sho are victims have been afflicted with sexual crime since the history of mankind had been started. Sexual assault crime is one of violent crimes in that it brings the loss of spiritual and material things to each victim, his relatives, society and makes victim spend his life in pain. Therefore, This paper aims to focus on actual condition, interpretation, and precedents of sexual crime which are stipulated on sexual criminal law and special law in order that we live free and humane life without sexual crime noticing the reality we cannot avoid sexual crime with only vague anxiety and caution.
