Internet Media and the Election System

대의제 형태로 이루어지는 현대 민주주의 정치체계 하에서 언론과 선거는 국민의 의사를 대변하는 두 가지 중요한 제도라고 할 수 있다. 선거제도를 통해서 국민의 의사에 부합되는 인물을 대표자로 선출할 수 있고 언론을 통해서 국민의 의사가 국정 전반에 반영될 수 있는 통로가 만들어진다. 특히 언론의 공정성은 선거의 민주성을 확보하는 데 결정적인 역할을 담당하고 있으므로 언론이 권력으로부터 일정한 거리를 두는 것이 필요할 것이다. 만일 언론이 권력에 영합하게 될 경우 국가권력의 민주성과 정당성에 심각한 위협이 될 수 있음은 물론이다. 국가권력의 정당성이 국민으로부터 나오는 것과 마찬가지로 언론의 힘도 국민으로부터 근원하는 것이 타당하다. 언론이 국민의 정당한 목소리를 담는다면 권력 자도 그에 귀를 기울이려고 할 것임은 당연하다. 그러므로 언론의 힘은 국민의 목소리를 정확하게 담고 있을 때 보다 강력해질 수 있는 것이다. 반면 언론이 국민의 의사에서 멀어질수록 그 힘은 약화되고, 왜곡되며, 부패하게 된다. 언론의 일차적 덕목은 공정성이고, 공정성의 확보는 언론매체의 중립성과 독립성에 기초한 국민의사의 정확한 반영에서 비롯되는 것이다. 특히 인터넷을 이용한 선거운동은 정치적으로 무관심한 계층의 참여를 유도하여 실질적 민주주의를 실현할 수 있게 하는 수단이 된다. 따라서 인터넷법제의 정비를 통하여 참여 민주주의의 초석을 마련하는 것이 시대적 요구라 할 수 있다. 인터넷을 이용한 새로운 형태의 선거운동이 제도적으로 실현될 수 있도록 해야 한다. 선거를 민주주의의 꽃이라고 믿고 있는 이유는 오늘날의 민주주의는 선거를 통해서만 이루어질 수 있기 때문이다. 이러한 점에서 인터넷 언론이 국민의 정치적 기본권 실현을 위한 유용한 수단이자 토대가 될 수 있도록 법제화 되어야 하는 것이 당위적 의무인 것이다.

The mass media and the election are two important systems that represent the will of the people under a democratic political system of today assuming the form of representative system. Through the election system, the representatives who meet the will of the people can be chosen and through the media, the channel can be created to reflect the opinions of the people across the overall national politics. It is necessary to keep a certain distance from government power especially as fairness of mass media play a decisive role to secure the democracy of the election. If the media cater to power, it goes without saying that they pose a serious threat to democracy and legitimacy of state power. As the legitimacy of state power comes from the general public, it is also reasonable that the power of mass media originates from them. If the media reflect the citizens’ reasonable voices well, it is also natural for political leaders to listen to them. Therefore the power of mass media can get stronger when they communicate accurately the citizens’ opinions. On the other hand, as the media become estranged from the voices of the people, their power becomes weak, distorted and corrupted. The primary virtue of the media is fairness and securing fairness comes from reflecting exactly the will of the citizens based on impartiality and independence of the media. Particularly election campaigns using Internet can be a tool to realize substantial democracy by attracting participation from people indifferent to politics. Accordingly, it can be said that it’s the demands of the times to lay the foundation of participatory democracy by modifying Internet laws and regulations. We should make certain that the new form of election campaign using Internet will be realized institutionally. The reason we believe that election is the essence of democracy is because modern democracy can be realized only through election. In this respect, it’s only natural that Internet media should be enacted to be a useful tool and foundation for realizing political basic right of the citizens.
