본 연구는 특수교육에 대한 권리성을 신장시키기 위해 이제까지 논의된 특수교육 관련 법적 연구를 검토하여 특수교육과 관련된 법적 논의 대상을 모색하는데 목적이 있다. 이를 위하여 우선 특수교육과 관련된 법적인 구조와 발전과정을 살펴보았다. 다음으로 특수교육 관련법에 대한 연구의 동향과 특징에 대해 고찰하였다. 마지막으로 특수교육 관련법에 대한 법적 논의의 대상과 과제를 제시하였다. 논의 결과 특수교육 관련법의 제정과 관련된 기초연구가 상당히 축적되어 있어, 보다 발전된 형태로 체계화시킬 필요성이 제기되었다. 이를 위해서는 특수교육 관련 법의 성격과 연구방법, 연구대상을 설정하는 문제, 헌법상 교육의 직접 조항에 대한 특수교육적 입장에서의 해석, 헌법과 교육기본법과의 관계나 헌법상 직·간접적 교육조항의 종합적 해석, 판례를 특수교육학적 입장에서 분석하는 성과의 구축, 보다 많은 쟁점을 부각시키기 위해 미국과 일본뿐만 아니라 보다 많은 나라의 법적인 규정 고찰 등의 과제가 제시되었다. 그리고 이에 대한 연구의 활성화를 위하여 학제 간 교류 환경을 조성하는 것이 중요함을 제안하였다. 그러나 본 연구는 개괄적 수준에서 선행 연구를 검토하여 법적 과제의 방향성을 제시하였기 때문에 구체적이고 면밀한 분석을 행하지 못한 한계가 있다.
The research attempted to explore issues and problems related to special education in legal aspects. For this end, first, the institutional processes of Special Education Law and Act of Special Education and their legal characteristics were reviewed. It was found that Special Education Law and its regulations were designated to achieve goals of education in general. Educational institutions for children with disabilities seem to attain more welfare than general educational institutions. Second, the tendency of law of special education and its specificity were discussed. Although studies in law of education in Korea were not much accumulated compared to other countries, efforts have been made to establish a disciplinary framework for approaches in special education, in legal aspects. Third, difficulties and possibilities in seeking legal framework for resolving issues in special education were discussed. Legislation, court case, administrative regulations, policies in special education are seemingly to be studied on the basis of the nature of Law of education. In conclusion, it was convinced that the fundamental right to be provided with education should be emphasized when legal issues and disputes in special education were considered.
