묵자 「상현」과 「상동」편에 내재된 정치 이론 고찰

묵자에 의하면, 사회 혼란은 개인 각자가 지닌 원칙과 기준이 다르기 때문에 발생하며, 이러한 혼란의 국면을 수습하고 이상적인 사회를 구축하기 위해 정장(政長)을 정점으로 하는 정치 제도의 설립, 즉 국가가 필요하게 되었다고 보았다. 묵자의 국가기원론은 통치자의 통치권에 대한 정당성을 보장해줌으로써 통치권의 안정을 도모하는데 그 일차적 목적이 있었다. 그러나 그것의 궁극적인 목적은 핍박받고 소외되어 있는 백성의 권위를 신장하고 보호하기 위한 것이다. 묵자는 현명함을 통치자가 지녀야 할 가장 중요한 기준과 자격으로 삼았다. 여기서 말하는 ‘현명’이라는 용어는 개인이 지니고 있는 현실적 능력이나 도덕적 자질마저도 포괄하는 것이다. 묵자는 현명한 사람을 등용하는 데 있어서 세습을 부정하고 능력을 등용의 잣대로 삼아 기회 균등의 의지를 표방하고 있다. 그에게 있어서는 영원히 귀한 사람도, 또 영원히 빈천한 사람도 없다. 진정한 현자를 등용하기 위해서는 신분이라는 틀로서 구속해서는 안 된다고 믿었기 때문이다. 묵자는 원칙에 입각한 국가 통치의 기반을 공고히 하기 위해 법치를 주장하였다. 그가 말하는 법이란 사회 변혁의 결과로 생겨난 것이며, 곧 하늘의 의지[天志]를 의미한다. 묵자가 보기에 하늘은 공정하고, 사사로움이 없으며, 두루 사랑하며, 널리 베풀고, 백성을 돕고, 선을 행하는 등의 의(義)를 행하는 최고의 의지였다. 이를 통해 볼 때 묵자는 인간 상호간의 사랑과 이로움을 나누기 위해 법의 작용과 목적을 설정하였으며 하늘의 역량을 빌려 통치자를 견제하고자 했던 것이다.

According to Mojia, upheaval in society happens because of people's different principles and standard. Political system will be required in the center of the chief to overcome the disorder and construct ideal society. Mojia's nationalism is, above all, to ensure the governor's sovereignty. On the contrary, the purpose of the sovereignty is to protect and extend the weak civil's rights. Mojia's wisdom has been looked upon as governors' manner. His wisdom is referred to as the chief's ability and morality. According to Mojia, not a hereditary right but real ability is more important than anything else in the terms of equality of opportunity. There is no ever person in the official position or in need. He believed that a wise man should not be restricted to a status system. He firmly insisted that a wise man's constitutionalism should be centered in ruling the country. The rule referred in his theory is originated in the necessity, the heaven's will, which is impartial, universally affectionate, helpful to the civil. That is, the heaven's will is superlative nature, whose goal and effect is to share the love and benefits among people. In this way, Mojia stressed that contemporary thoughts, heaven's will control the governor for the peaceful civil's lives.
