신도시개발지내 학교신설비 재정부담의 주체에 관한 논의

Analysis of the Issues of The Main Body of Financial Burden on Construction Expenses of New school in New Urban Development

학교신설의 책임은 국가에 있으며 국가는 공교육을 위해 모든 비용을 부담해야 한다는 것이 기존의 생각이었다. 그러나 국가 위주의 공교육의 책임이 중앙정부에서 지방정부로 이양이 확산되고, 특히나 지방정부 주도의 대대적인 도시재개발 사업이 진행되면서 학교용지 재원 부담 주체 논쟁과 그로 인한 학교시설의 적기 공급이 늦어지면서 교육수요자의 권리가 침해되고 있다. 최근 이와 관련하여 「국토의 이용 및 관리에 관한 법률」의한 공공시설로 전환해야 한다는 논의가 탄력을 받고 있다. 이 논문에서는 공공시설이 무상귀속과 설치부담 주체를 살펴보고, 학교시설을 합법성과 합리성, 비례성과 실현가능성, 형평성이라는 관점에서 그 타당성을 검토해 보았다.

The purposes of this study are to analyze the issues of the main body of financial burden on construction expenses of new school in new urban development, and to suggest that the school facility should be converted into the public facility on account of the public responsibility in education. We analyzed the demands of school establishment and the cost of development conditions, development profits, and urban renewal, and reviewed that the validity of converting the school facility into public facilitiy includes legitimacy·rationality, proportionality·feasibility and fairness. The results of this study have showed that the business developmentor should provide school facility for local school districts on free.
