교육목적의 법적 규정에 대한 교육철학적 논의

A Discussion of Educational Philosophy for Education Aims related with the Education Law

우리나라는 의회민주주의를 지향하고 있으며, 법률은 다수결의 원리에 의해 결정된다. 대의제 하에서 법률은 국민의 총의가 반영된 것으로 간주되므로, 법률이 정하는 바에 따라 국가가 교육내용에 관여하는 것이 인정된다. 교육목적과 관련된 사항도 법률에 규정되어 있으며, 어느정도 수준까지 제시되어 있느냐에 따라 국가의 관여정도가 달라지게 된다. 국가의 관여 정도가 많을수록 교사를 비롯한 국민측에서 교육의 자유는 그 많큼 제한된다. 본 연구는 법률에 규정된 교육목적에 대한 논의를 토대로 교육목적의 구체적 내용면에 대한 과제를 모색하는데 목적을 두고 있다. 이를 위해 우선 공교육에서 국가의 역할과 교육의 자유에 대한 관계를 살펴보았다. 다음으로 현행 법률상 교육목적의 체계를 살펴보고, 국가와 국민측의 교육에 대한 권리나 권한에 따른 특징을 살펴보았다. 마지막으로 법률에 규정된 교육목적에 대한 구체적 검토를 위해 교육법에 관한 철학, 교육목적 법정화의 근거, 교육목적 법적 규정의 수준, 광의의 교육목적으로서 교육이념 규정의 타당성에 대한 논의를 하였다. 논의결과 과거 법률에서 규정하던 교육목적의 일부를 법률 이외의 사항으로 결정할 수 있도록 함으로써 교사, 교과전문가, 학부모 등 국민측의 교육의 자유가 보다 확대될 수 있는 여건이 마련되고 있다. 그러나 교육목적과 관련된 타 조항과의 관계에서는 여전히 제한성이 있었다.

This research is attempted to explore issues and problems related with aims of education in legal aspects. To accomplish this goal, the roles of nation and free of education in public education were reviewed. It is found that the public education were designated to harmonize the regulation of nation and autonomy of education in school. But in the viewpoint of education, the content of education seems to pursue more autonomy than control in the power of nation. Second, the system of education aims in education law and its characteristics are discussed. The ideal education of the people is prescribed to the ‘Framework Act on Education’ and the aims of education are provided for the ‘Elementary and Secondary Education Act’. Third, issues and problems related with the legal aspects in education aims are discussed. The nature of philosophy in education law, background of legal regulation for aims of education, regulation of the objectives of education, validity of humanitarian ideal are seemingly to be studied on the basis of the philosophical nature to education law. In conclusion, the education is extended to the rights of people compared to legal regulations in the past. But there are still limitations on articles relating to educational aims.
