보험범죄 수사제도의 개선방안에 관한 연구

경기침체와 서민경제의 불황속에 계속되는 보험범죄는 감소가 아닌 증가추세로 나타나고 있다 국민과 기업의 약70% 이상은 보험에 가입하여 앞을 예견할 수 없는 육체적 금전적 정신적 등의 사고에서 조금이나마 경제적인 부분을 벗어나고자 한다 하지만 이러한 좋은 제도를 악으로 이용하여 개인의 이득을 위하여 불법적으로 편취하는 사례가 많이 발생한다 하지만 국내의 보험업계와 수사기관은 “소 잃고 외양간 고치는”식으로 급급하게 대처방안을 마련하고 있다 보험업계는 사기업이기 때문에 자사의 손실을 막기 위하여 보험범죄에 대한 대책과 조사제도를 적극적으로 마련하지만 형사사법기관은 조금 소홀하게 대처하고 있다고 생각한다 이러한 관점에서 현 국내에 발생하고 있는 보험범죄사범의 적발사례와 검거통계 및 적발건수를 바탕으로 연령, 직업, 적발금액, 종류별로 나누어 동향분석을 하였다 동향분석을 바탕으로 우리나라 보험범죄수사제도의 조명을 통하여 수사권이 있는 형사 사법기관(검찰과 경찰)과 수사권이 없는 보험회사의 SIU(Special Investigation Unit 보험범죄 특별조사부서)를 대상으로 문제점을 도출하였다 문제점 도출에 있어서 소극적으로 대응하는 형사사법기관은 각 기관에서 보험범죄업무를 담당하고 있는 겸찰 수사관과 경찰 사법 경찰관의 인터뷰조사를 통해 각각의 문제점을 도출하였다 문제점 도출과 함께 외국의 보험범죄관련 수사제도와 단체를 고찰하여 국내에 필요한 보험범죄수사제도의 개선방안과 정책적 함의를 하였다
