A Study on the Induction of Private Investigation Systems

최근 국회에서 이인기 의원이 대표 발의한 경비업법 개정안이 사회적 이슈화되고 있는데, 주요 내용은 민간조사업제도 도입에 관한 사안을 다루고 있다 그동안 심부름센터의 불법행위가 사회문제시됨에 따라 이들에 대한 국가의 체계적인 관리가 필요하다는 점에서 법안 개정의 의의가 있다 하겠다 그러나 민간조사업제도의 도입에 대한 사회적 합의와 법률적 검토가 더욱 세부적으로 필요한 것이 사실이다 특히 민간조사업의 업무범위와 민간조사관의 자격문제, 민간조사에 따른 불법피해의 구제 문제 등 앞으로 사회문제활 될 수 있는 사안들이 여전히 존재하고 있다 이러한 문제를 해결하기 위해서는 경찰-학계-업계의 다각적인 논의와 여론수렴을 위한 공청회 등을 통하여 합리적이고 공정한 민간조사업제도의 도입을 이끌어야 할 것이다 또한 민간조사인력의 질적 향상을 위한 교육훈련제도의 마련도 반드시 선행되어야 할 것이다

In this paper, the growth of domestic and foreign private investigation service is described, and the authorized legalization of the private investigation system is studied, on the philological basis, as a measure to overcome the limit of the force of the prosecution and the police, to foster the decentralization of these two governmental agencies' authority, to take precautions against foreign detective companies' inroad into the domestic market, to activate the private security, to develop the Science of Security for Property & Personnel and to elevate the standard of living The writer of this paper suggests a desirable plan to legalize the private investigation system as follow 1) The Public Prosecutor's Office is to be designated as the substantial agency to supervise the Private Investigation Service Bill 2) The title of the bill is to be 'the Authorized Private Investigation Service Law, and the person to carry out the private Investigation service is to be called 'the Authorized Private Investigator' 3) A state screening examination is to be taken to improve the ability of authorized private investigators qualitatively
