Amendment Measures for Laws and Regulations Related to Financing Early Childhood Education

이 연구는 유아교육재정 관련 법제의 구조와 내용을 분석하고 문제점을 추출하여 개선방안을 제시함으로써 유아교육재정을 용이하게 확충하는 법제구조를 마련하는 데 목적이 있으며, 관련 법령과 연혁법령, 국회회의록 등을 수집하여 내용을 분석하는 방법을 주로 활용하였다. 이 연구에서 「교육기본법」, 「지방교육재정교부금법」, 「유아교육법」 등의 문제점을 분석한 후 제시한 개정방안을 요약하면 다음과 같다. 첫째 「교육기본법」의 유아교육진흥조항은 삭제되어야 한다. 둘째 「지방교육재정교부금법」에 내국세 총액의 0.6%를 재원으로 하는 분권교부금을 신설하여 유아교육 지원사업비에 충당해야 한다. 셋째, 유아교육책임 소재 및 유아교육재원에 대한 국가 부담 규정을 명료화하고, 사립유치원에 대한 재정지원 범위를 확대하며「유아교육법」에도 유치원 설치를 규정하여 사업주가 유치원과 보육시설을 선택하여 설치할 수 있도록 한다.

The purposes of the study are to investigate the content and structure of laws and regulations related to financing early childhood education, to analyze the problems of them, and to suggest amendment measures for them. The method of the study is the content analysis of laws and regulations, their history and assembly records related to financing early childhood education. Amendment measures for laws and regulations related to financing early childhood education are as follows. First, The article for promotion of early childhood education(The Basic Law of Education, §20) should be deleted. Second, the Decentralization Grant should be establish newly(the Grant Law for Local Education, §3) for the aid program of early childhood education, by means of a revenue source is 0.6% of the total amount revenued of internal taxes. Third, The Law of Early Childhood Education should be revised, that is, it is necessary to clarify the article of state's sharing the revenue of early childhood education(§26), to expand the scope of aid program to private kindergartens(§32), and to assign a duty to a business proprietor to establish the kindergarten or the nursery for workers' infants(§10-2).
