지적사무 배분에 관한 연구

A study on the Distribution of Cadastral Affaris

본 연구는 국가와 지방자치단체간의 행정사무 배분 논의에 입각하여 지적사무의 본질과 법적 성격을 규명하고 그에 따른 사무배분의 합리적 방향이 어떻게 제시되어야 할 것인지를 모색해 보고자 하였다. 이를 위해, 연구대상을 지적사무의 배분으로 한정한 후, 사무배분에 관한 기초 이론과 관련 법령의 규정 및 그에 따른 판례를 바탕으로 법해석학적 방법과 기술적(記述的) 분석방법을 동원하였다. 연구결과, 현 정부가 기관위임사무를 폐지하는 입법정책을 권고하는 시점에서 기관위임사무인 지적사무를 전적인 국가고유사무로 회귀하는 것보다는 일본이 기관위임사무를 폐지하고 ‘법정수탁사무’를 도입한 사례과 같이 우리나라도 지적사무를 정부 상호간 분권이 보장될 수 있는 수탁사무로 전향할 것을 제언하였다. 즉, 지방자치제도의 본래 취지 및 지방분권화를 통해 기대할 수 있는 행정의 효율성과 능률성 등을 고려하여, 지적사무에 대한 지방자치단체의 실질적인 기능과 권한이 보장될 수 있는 공동사무형의 사무배분이 요청된다는 점을 피력하였다.

This study aimed not only to grasp the essence and legal quality of cadastral affairs but also to examine the way to distribute it between central government and local government from the standpoint of decentralization of power. To achieve this purpose, the object of study was firstly focused on cadastral affairs. Then the existing sundry records were referred. And also, judicial precedent were annotated. Occasionally, the Japanese case of administrative affairs were compared to our country in order to undertand the actual state more definitely. As the result, this study suggested that the cadastral affairs which has been delegated from the central government to the local government should be redistributed in order to entrust local government with full autonomy. In addition, this study proposed that the central government has better consider the distribution system of Japanese administrative affairs system, such as "consigned affairs by law". In conclusion, to established the cooperation system of intergovernmental cadastral affairs, the authority of substantial functions and responsibilities of should be firstly given to the local government.
