Trade and Environment

본 논문은 무역과 환경의 연계성이 증가하고 있으며 또한 양자간 분쟁가능성도 증가하고 있는 점을 인식하면서 DDA 환경협상에서 논의되고 있는 주요 이슈들을 분석하였다. 첫째, 무역과 환경이슈가 GATT/WTO체제하에서 발전해온 과정과 환경관련 무역분쟁을 검토하였다. 둘째, 바젤협약과 몬트리얼협약 등 다자환경협약에 규정된 무역관련조항(STO)의 성격을 살펴본 뒤에 동 조항과 WTO협정과의 관계를 분석하였다. 그 다음으로, 환경상품의 정의와 관련된 세 가지 접근방식과 다자무역협정 사무국과 WTO 환경관련 위원회와의 정보교환 개선방안 등에 대하여 논의하였다. 끝으로, 향후 주요 과제로 제시한 생산방식(PPM) 판정기준과 환경상품과 환경서비스의 연계성에 대하여 간략히 논의하였다.

Recognizing the increasing linkage and possible conflict between trade and environment, we analyze the trade and environment issues, focusing on the DDA environment negotiations, with a view to providing some guidance for the negotiations. First, we review how the trade and environment issues have been evolved at the GATT/WTO and examine environment-related WTO disputes. Second, we discuss the characteristics of specific trade obligations (STOs) in multilateral environmental agreements (MEAs) and the relationship between WTO and MEAs. In particular, we analyze STOs in CITES, Basel Convention, Montreal Protocol and other MEAs. Third, we discuss how to improve the information exchange between MEA Secretariats and the relevant WTO committees and the criteria for the granting of observer status. Next, we analyze the issues concerning identification and definition of environmental goods. We also compare the three approaches to identifying environmental goods: list approach, environmental project approach and the integrated approach. Finally, we touch upon briefly future issues to be explored further at the CTESS. They include PPM criterion and the linkage between environmental goods and services.
