포괄적 안보 개념 하에서의 국가 위기관리 법제화의 의의와 내용 분석

이 연구는 포괄적 안보 개념 하에서의 국가 위기관리 법제화 방안을 마련하는 데 목적이 있다. 이를 위하여 포괄적 안보 개념 하에서의 국가 위기와 국가 위기관리의 의의를 고찰하고, 국가 위기관리 환경의 변화와 법제화의 필요성을 검토한 후, 국가 위기관리 법제화에 필요한 주요 내용을 살펴보았다. 연구 결과, 법제화의 주요 내용은 다음과 같다; ①국가 위기관리의 효율화를 위한 전문인력의 양성 및 확보, ②다부처에서 다루고 있는 다양한 종류의 국가 위기를 체계적으로 관리하기 위한 표준화 방안, ③국가 위기관리의 연구 및 개발 역량 발전, ④국가위기관리 산업의 진흥, ⑤국가 위기관리에서의 정부와 시민사회 연계, ⑥국가 위기관리의 국제적 협조 체제 구축, ⑦국가 위기관리 문화의 형성 및 유지·발전, ⑧국가위기관리에서의 갈등관리 및 협상 능력의 향상, ⑨위기관리에 대한 학교 교육 및 평생 학습 추진 등이 그것이다.

This topic is now carefully considered by the scholars and administrators because the national crisis and emergency management system in korea appears to have revealed the problems. The purpose of this study is to provide the legislation principles and contents, etc. for the systematization of the national crisis and emergency management. As a result, this paper suggests the following main contents for the legislation. First, the national crisis and emergency management system demands the specialists and experts. Second, it is necessary that we should equip the standardization for acquiring the efficient management system. Third, we have to increase the research and development(R & D) capability. Fourth, to revitalize the crisis and emergency management in everyday life and all the area of society, we must promote the new industry in connection with the crisis and emergency management. Fifth, in the process of legislation, the close cooperative relationship should be established between the government and the civil society. Sixth, for developing our responding ability, we have build up the international cooperative foundation. Seventh, for establishing the safe society in the long time, it is important that the crisis and emergency management culture should be formed and developed. Eighth, to reduce the social crisis, we have to enhance the conflict management and negotiation ability. Finally, we have to make progress the regular school education and lifelong study of the crisis and emergency management.
