소년보호기관의 효율적 운영방안에 관한 연구

The Schemes for Efficient Operation of Juvenile Protection Institutions

청소년기의 비행 및 범죄는 평생동안 지속될 수도 있고 일반적인 견해로 단순히 성장과정에서의 일시적인 현상으로도 이해할 수 있다. 이러한 청소년기의 중요성이 강조되는 상황에서 현재 소년보호기관의 상황은 선진외국에 비해 열악한 환경적 요인을 가지고 있다. 이 연구에서는 소년보호기관의 운영실태를 통해 구체적인 현황을 파악함으로써 이에대한 문제점을 지적하고, 소년보호기관 운영의 문제점에 대하여 현실적이고 구체적인 대안을 제시하고자 하였다. 소년보호교육기관에서 소년원, 소년분류심사원의 기능과 역할 그리고 특성화교육을 고찰하였고, 소년분류심사원에서의 개방처우 등 최근에 새롭게 변화하고 있는 프로그램을 정리하였다. 이러한 소년보호기관의 노력에도 불구하고, 소년보호기관의 교정교화역할, 특성화교육부실, 퇴원ㆍ가퇴원 대상자 선정절차의 문제, 비행예방 노력의 부족 등의 문제가 제기 되었다. 이러한 문제점을 극복하기 위해 소년보호기관의 역할의 강화와 특성화교육의 내실화, 퇴원ㆍ가퇴원 대상자 선정절차의 개선, 청소년비행 예방을 위한 역할확대 및 강화를 제시하였다.

Juvenile delinquencies and crimes may be continued for a lifetime and it may be simply understood from a general standpoint as temporary phenomena in growth processes. The importance of the juvenile period is to be stressed, but current conditions of juvenile protection institutions in Korea are poor in comparison with those in advanced countries. This research aims to investigate into present conditions of the operation of juvenile protection institutions, pinpoint problems of the operation, and suggest realistic and detailed alternatives to the problems. While considering the Juvenile Protection and Education Institution, investigations were made into the functions and roles of the Juvenile Reformatory and the Juvenile Classification Examination Institute and into specialization education. And studies were also made of newly emerging programs like open-door treatments adopted by the Juvenile Classification Examination Institute. Despite lots of endeavors made by juvenile protection institutions, it is found that there are many problems including those related to the roles of juvenile protection institutions for correction and edification, poor specialization education, the selection of the inmates who will be fully released or released on probation from juvenile protection institutions, the lack of efforts made to prevent juvenile delinquencies. In order to solve such problems, suggestions are made for strengthening the roles of juvenile protection institutions, intensifying specialization education, improving the processes to choose the inmates who will be fully released or released on probation, and expanding & reinforcing the roles of juvenile protection institutions to prevent juvenile delinquencies.
