A Study on historical changes in rejection procedure under UCP

The surveys carried out in the U.K. by SITPRO shows that the rate of discrepancy was 50%, 48%, 50-60% between 1983-1984, 1989-1991 and 2001-2002 respectively. The rejection rates seem to be static. During the revision process, there are many inquiries pertaining to 7 Articles(9, 13, 14, 21, 23, 37, 48). In particular Article 14 (Discrepant Documents and Notice) resulted in more ICC Opinions than any other article. This article is changed into Article 16 under 600. The purpose of this paper is to analyse the provisons on rejection procedures including Discrepant Documents, Waiver and Notice under UCP 600 and to examine some of the changes made and improvements of UCP 600 compared with UCP pre-600. For this purpose, first this study deals with the relative provisions on rejection procedures including Discrepant Documents, Waiver and Notice under pre-UCP 600. Secondly, this study considers the corresponding provisions under UCP 600. Finally, this study compares the provisions under pre-UCP 600 with the provisions under UCP 600. This paper contribute to help the parties to letters of credit to understand the provisions on rejection procedures including Discrepant Documents, Waiver and Notice in Documentary Credit Transactions.
