경찰은 시민들의 작은 성의표시(gratuities)조차 거부해야 하는가?

시민들이 경찰공무원에게 조그마한 성의표시(호의표시)로서 공짜로 커피나 아이스크림을 제공한다면, 경찰공무원은 그것을 거부해야하는가? 여기에서는 경찰공무원의 부패와 관련하여 경찰공무원에게 제공되는 시민들의 작은 성의표시, 예컨대 공짜커피 따위를 허용해야할 것인가, 아니면 이것조차 거부하도록 해야 할 것인가를 다룬다. 시민들의 경찰공무원에 대한 도덕적 신뢰의 붕괴는 곧 시민들의 준법정신의 해이를 야기할 것이고 급기야는 사회전체의 비도덕성을 초래하게 될 것이다. 따라서 경찰공무원의 부패는 경찰공무원만의 문제로 끝나지 않고, 사회 전체로까지 그 파장이 미치게 된다. 그렇다면 경찰공무원은 그 누구보다도 도덕적이어야 하며, 타 공무원에 비하여 높은 수준의 윤리성을 갖춰야 한다. 그렇다면 경찰공무원에게 제공되는 시민들의 작은 성의표시는 과연 경찰공무원의 부패를 야기하는 원인이 될 수 있는가? 그리고 그것을 받아들이는 경찰공무원의 태도는 비윤리적인 것이어서 비난 받아야 할 것인가? 이를 다루기 위해 먼저 경찰공무원의 부패가 일어나는 원인을 먼저 규명해 본다. 이어서 경찰공무원에게 제공되는 시민들의 조그마한 호의표시(성의표시)를 허용할 것인지의 여부에 대한 여러 학자들의 의견을 다룬다. 시민들의 조그마한 호의표시에 대해서 경찰공무원이 그것을 받아들여야 한다는 주장과 그 반대의 주장이 있는데. 각 입장의 논거를 소개하고 그 논거에 대해서 비판을 가한다. 아울러 경찰헌장의 태도는 어떠하며, 실정법의 태도는 어떠한 지를 살펴본다. 끝으로 시민들이 제공하는 성의표시(호의표시)에 대해서 경찰공무원은 어떤 태도를 취하는 것이 바람직한지를 밝힌다.

If citizens offer coffee or ice cream for free as petty gratuities to police officers, should they refuse them? The study will discuss on whether the government will allow police officers to receive things as coffee from citizens as citizens’ petty gratuities or not, with regard to police officers’ corruption. Collapse of moral reliability for police officers of citizens will cause citizens’ laxity of moral fiber and bring about immorality of the whole society. Therefore, corruption of police officers is not a problem of only police officers and will have an effect on the whole society. Therefore, police officers should be more moral than any other and should have higher-level morality than other civil servants. If so, can citizens’ gratuities offered to police officers bring about corruption of police officers? And should police officers’ attitude receiving the gratuities be criticized since the attitude is not moral? To answer the above questions, the study makes a close inquiry into causing police officers’ corruption in advance. Next, the study treats various scholars’ opinions about whether the government allow police officers receive citizens’ petty gratuities or not. Some scholars argue that the government should allow police officers to receive citizens’ gratuities and other scholars argue that the government should not allow them to receive citizens’ gratuities. The study introduces about arguments of each position and criticizes them. In addition, the study examines what positive laws are and what police ethics charter’s attitude is. Finally, the study unveils that it is desirable what attitude police officers take with regard to gratuities offered from citizens.
