우리나라 테러방지관련법에 관한 연구

A Study on the Korea Anti-Terrorism Act

이 연구는 국제테러조직으로부터 국민의 생명과 재산을 보호하기 위해 외국의 대테러방지관련활동과 입법례를 살펴보고, 우리나라의 대테러방지관련형사법 및 유관기관의 업무실태, 국회에 발의되어있는 대테러방지관련 법안을 고찰하여 국가의 안보와 국민의 안전을 테러의 위협으로부터 보호할 수 있는 방안을 마련하는 것에 목적이 있다. 이를 위하여 우리나라의 대테러관련법 및 유관기관의 대테러업무와외국의 대테러정책 및 주요법안을 고찰하고, 현재국회에 발의되어 있는 테러방지관련 법안을 검토한 후 테러방지관련법 제정을 위한 정책적제언을 하였다. 연구결과 주요한 점들을 살펴보 면, 테러방지관련법안의 조속한 제정, 대테러 총괄 기획·조정 기구의 상설, 인권침해문제, 테러경보 시스템의 개선,군병력지원 등이다.

After the September 11th terrorist attacks, korean people are worried about that terror attacks may be organized and executed against unspecified persons. But most of the people do not trust counterterrorism measures arranged by the government. They feel necessity for the Anti-Terrorism Act and the far-reaching responsible for all the issues associated with terrorism. The reality we face drives us to enact the Anti-Terrorism Act. Finally, both the ruling and opposition parties push forward with a bipartisan initiative of passing another bill of the Anti-Terrorism Act from July to November 2004. Again, we must check whether the bill is either a bad law infringing on human rights or necessary to protect the people from terror attacks.
