Certain Main Issues in the Revised Uniform Rules for Demand Guarantees

In cooperation with the Commission on Commercial Law and Practices and the Commission on Banking Techniques and Practice of ICC, the URDG458 has been revised under the new name, UROC758. This new demand guarantee rule is to be used officially from July 2010. UROC758 has been substantially influenced by UCP600 and, to some extent， ISP98. The new URDG, for instance, accommodates the preclusion rule, the rules of issuance of the notice of rejection， and the treatment of non-documentary conditions etc., which are contained in UCP600 and several related points from ISP98. UROG758 is also intended to reflect and guide some critical practices(such as the 30day rule in several areas explained in this paper) among banks, pr이ect owners and contractors. With these practical advances over the previous URDG458 and less complicated content compared to ISP98, UROG758 has become more beneficial especially to those which are engaged in factory construction and ship-building. Moreover, these 3 industries are crucial for Korean economic growth, and therefore, practitioners in those industries and bankers need to thoroughly understand UROC758
