공무원의 정치적 표현의 자유와 제한

얼마 전 공무원노조의 민주노총가입에 관하여 국가가 반대 입장을 표명함에 따라 논란이 된 바 있으며， 최근에는 공무원의 정치 활동을 금지하는 내용의 ‘국가공무원 복무규정 개정안’에 대해 국가인권위원회가 반대 입장을 밝힘에 따라 공무원의 표현의 자유 및 정치적 중립과 관련된 문제들이 우리사회의 뜨거운 감자가 되고 있다. 이러한 정치적 표현의 자유는 정신적 자유와 정치적 자유의 핵심으로， 인간으로서 존엄과 가치를 유지하고 행복을 추구하는데 있어서 가장 기본적인 권리인 동시에， 현대 민주주의에서 국민주권을 실현하는 필수불가결한 궁극적 기본권이다. 현행 헌법과 법률은 공무원에게 정치적 중립을 요구함에 따라 공무원의 정당·정치단체 가입 및 이들에 대한 지지·반대， 정치적 의견을 발표하거나 신문 등 간행물에 게재하는 것을 전면 금지하고 있다. 물론， 그 이유가 공무원 인사에 대한 정치적 간섭을 배제 하여 공무원의 신분을 보호함으로써 행정의 안정성과 전문성을 확보하려는 등의 여러 가지 필요성에 있다고 하더라도 과도한 제한은 공무원의 표현의 자유를 원천적으로 가로막는 구실을 하는 바， 공무원들이 정치에 대해 침묵으로 일관하는 것이 과연 민주주의 발전과 본인들의 기본권을 위해 바람직한 것인가에 의문이 제기된다. 공인인 그 직위를 이용한 정치적 의사표시를 하는 것은 금지 할 수 있지만， 국민 한 사람이라는 개인으로서 하는 정치적 의사표시까지 금지하는 것은 과도하게 표현의 자유를 부정하는 것이다. 개인의 사적지위와 공적인 지위를 구분하여 공적인 공간에서의 정치적 의사표현을 제한할 수 있지만， 국민 개인으로서 정치적 견해를 표현하는 등의 정치활동은 보장되어야 한다. 인간은 본성적으로 정치적 동물(Homo politicus) 이다. 공무원의 정치적 중립성을 과도하게 요구하는 것은 인간 본성에 대한 부정이며， 기본권에 대한 본질적 침해이다.

Freedom of expression serves as a basis of all freedoms and cornerstone of democracy and defines the scope of expression ability of the society. The society which allows their members to enjoy freedom of expression, which we call, democratic and constitutional society pursuing human right values. In Article 21 of our Constitutional Law, freedom of expression is mentioned. So our nation guarantees freedom of expression of all the people. But In Article 7 of our Constitutional Law, political neutrality of civil servant is indicated. So civil servant' s Freedom of Political Expression is limited owing to special authority relation. accordingly In Article 65 of Civil Service Act and 57 local public servants Act, political movement of civil servant is prohibited, and in Article 66 of Civil Service Act and 58 local public servants Act, collective declaration of intention is forbidden, too. It is a general principle of law that restricts the fundamental rights as respects someone that belongs to Special authority relation within the scope of rationality and necessity to secure administrative stability and specificity. But in our nation, civil servant's freedom of political expression is restricted so strictly compared with advanced countries. Man is the Homo politicus. So excessive limits to civil servant's political freedom of expression infringe fundamental rights essentially. In conclusion, restriction of political freedom of expression caused by political neutrality of civil servant must be relaxed.
