해양영토와 관련된 2000년 이후 ICJ 판결 분석

A Critical Analyzation of the ICJ Decisions Relating to the Maritime Territory Since 21st Century : A Study on the Implications of ICJ Decisions for the Solutions of Dokdo Problem

2000년 이후, 해양영토분쟁 판결 사건 중 주목할 만한 사건으로 2001년 ICJ 의 바레인과 카타르 간 하와르(Hawar) 섬 사건, 2002년 ICJ가 판결을 내린 인도네시아와 말레이시아 간의 리기탄-시파단(Ligitan and Sipadan) 섬 사건 그리고 2008년 5월 23일 ICJ에 의해 판결이 내려진 말레이시아와 싱가포르 간의 페드라 브랑카, 미들 락스, 사우스 레지(Pedra Branca, Middle Rocks, South Ledge) 섬 사건이 있다. 이상의 사건들은 모두 도서의 영유권에 관한 분쟁사건으로, 영토분쟁에 관한 국제사법재판소의 보편적 판결기준을 확인할 수 있다. 이 논문에서는 위의 사건을 분석하여 한국과 일본 간에 문제가 되고 있는 독도영유권 문제의 해결을 위한 시사점을 짚어보았다. 판결내용을 살펴보면,실효적 지배의 원칙과 같은 보편적 판결기준 외에 특별한 사정에 의한 영유권의 이전 등이 판결의 기준이 되었다. 또한 판결에 있어 가장 중요한 요소는 증거력이 있는 증거의 존재이다. 국제사법재판소의 판결기준에 입각하면, 한국과 일본 중 독도의 영유권에 대한 객관적인 증거를 많이 확보한 나라가 독도에 대한 영유권을 인정받게 된다. 따라서 우리 정부와 역사학자.국제법학자들은 이와 관련된 증거의 확보와 체계적인 이론의 정립으로 독도에 대한 한국의 영유권을 공고히 하여야 할 것이다.

Since 21st Century, the ICJ decisions relating to the maritime territorial disputes such as the dispute over the Hawar Islands between Bahrain and Qatar, ruled by the ICJ in 2001, the dispute over the Ligitand-Sipadan Islands between Indonesia and Malaysia, ruled by the ICJ in 2002, and Malaysia and Singapore's dispute over Pedra Branca Islands in 2008 are important for the solutions of Dokdo Problem. The above cases suggest the general criteria of ICJ decision regarding to the maritime territorial dispute. This writer analyze the ICJ decisions and deduce its implications for the solutions of Dokdo Problem. The Analyzation suggested the Court rendered each case according to the general principle regarding the solution of territorial dispute such as the principle of effective possession, and they considered the special circumstances for each case. The most important thing in the Court is the probative evidence. Therefore, the Korean government, historian and international lawyer have to find the probative evidence and make the rationale theory for the solidification of Korean sovereignty over Dokdo.
