북극해 대륙붕 한계에 관한 법적 문제

Legal Issues on the Limits of the Continental Shelf in the Arctic Ocean

북극은 오랫동안 방치되어 온 수역으로 최근에 와서야 북극해 빙하의 급격한 해빙으로 기후변화문제가 심각하게 제기되자 관심을 갖게 되었으며 동시에 이 해역에서의 자원 개발 및 지정학적 고려 등의 요인으로 전세계의 관심지역으로 부상하게 되었다. 즉 새로운 기회에의 도전을 북극이 부여하고 있음에도 여전히 대다수 북극해 국가들은 아무런 문제가 없고 현 체제가 지극히 정상적이라고 주장한다. 그러나 이는 반드시 그렇다고만 볼 수 는 없는 바,주지하다시피 북극은 북극 그 자체의 법적 지위를 포함하여 매우 복잡한 구조를 갖고 있으며 또한 지속적으로 북극해의 지형이 변화하고 있다는 사실을 고려할 때 이들 문제의 해결을 위해 새로운 법률체계의 도입이 시급히 요청됨은 당연한 요구일지도 모른다. 특히 북극은 미발견된 자원의 보고로서 최근연구에 의하면 전세계 미발견 천연가스(gas)의 30% 그리고 전세계 미발견 석 유(oil)의 13%가 북극에 매장되어 있다고 한다. 따라서 그동안 관심을 받지 못했던 북극해 대륙붕 문제가 자원의 탐사 및 개발을 목적으로 수면상으로 급부상하게 되어 국제사회의 관심을 불러일으키고 있는바, 본고에서서는 이에 초점을 맞추어 북극해 대륙붕 한계문제의 현황을 고찰하고 향후 이 문제가 어떻게 해결가능한지 등을 전망해 보고자 한다.

The Arctic was neglected for a long time, but nowadays it became a concerned zone by the international society mainly due to climate change, resources development and geo-political consideration. Despite of the fact of the fundamentally changing character of the Arctic, most of the countries concerned, particularly the Arctic states claim the Arctic has nothing to be reconsidered, which means the Arctic is simply normal and fine. But, the Arctic has a lot of complicated systems including its own legal status in the law of the sea, and so if we consider that it's geography is gradually and consistently changing, it seems to require a new type of covernance to be applied to the Arctic for the settlement of current and future issues. According to the recent survey, the Arctic, one of the treasury of undiscovered resources, contains 90 billion barrels of oil (13% of the world's undiscovered oil) and 43.3 trillion cubic meters of gas (30% of the world's undiscovered natural gas). The continental shelf itself of the Arctic Ocean is becoming a core region in the world with a view to developing and exploring it. Therefore, the article examines the current issue of the continental shelf of the Arctic Ocean and will have a prospect carefully how the problem can be solved in the future.
