난파물 제거협약(WRC)의 가입타당성에 관한 연구

선박의 침몰 등으로 선박 및 적재화물이 해양에 표류하는 경우 다른 해양사고를 유발하거나, 해양오염을 유발시키게 되지만, 유엔해양법협약(UNCLOS)에 의하면 EEZ에 난파된 선박이 해양환경에 급박하고 심각한 위협요소가 되지 않은 한, 연안국은 선박의 소유자에게 동 난파물을 제거를 강제할 권한이 없기 때문에 연안국은 해양안전을 확보하기 위해 자국의 비용으로 이를 제거할 수밖에 없었다. 따라서 국제해사기구(IMO)는 2007년 케냐의 나이로비에서 EEZ에서 발생한 난파물에 대하여 선주에게 제거의무를 부과하고, 이를 담보하기 위하여 보험가입을 강제한 난파물 제거협약(WRC, Wreck Removal Convention)을 채택하였다. 최근 우리의 영해 및 EEZ에서 발생한 해양사고로 인한 난파물 제거를 위한 행정대집행 비용의 일부 또는 전부를 회수하지 못하는 사례가 빈번하게 발생함에 따라 영해뿐만 아니라, EEZ에서 발생한 해양 사고에서의 난파물 제거를 위한 보험을 강제화하고 있는 동 협약에의 가입 필요성이 강하게 제기되고 있다. 본 논문은 난파물 사고사례 및 외국의 입법례, 시사점을 살펴본 다음, 동 협약 가입에 따른 편익분석을 통하여 가입 타당성을 분석하고 가입시기를 제시하였다.

Recently, International Maritime Organization(IMO) adopted "NAIROBI International Convention on the Removal of Wrecks, 2007" at the Diplomatic Conference that held in Nairobi, Kenya in 2007. This Convention provides the uniform international rules and procedures to ensure the prompt and effective removal of wrecks and payment of compensation for the costs therein involved. This study aims to analyze the validity of joining the Convention on the Removal of Wrecks, 2007. So as to analyze the validity, firstly, this study examines not only a case analysis of the accidents on wrecks but also domestic and foreign law-making examples on wrecks. Secondly, this study examines the main contents and significance of this Convention. Finally, this study carries out cost-benefic analysis in order to analyze the validity and shows favorable time of joining the Convention on the Removal of Wrecks, 2007.
