Himalaya Clause in Multimodal Transportation and the Liability of Non-vessel Operating Common Carrier

Even with the new Rule of 'Basic Act of logistics Policy' to improve international logistics forwarding business, Korean multirnodal transportation is faced with several legal issues not yet resolved. Given the comparative analysis of freight forwarding system between the U.S. and Korea, this study attempt to find certain practical, legal basis for the proper operation of freight forwarding system with a case analysis of recent decision in the U.S. Supreme Court. Reviewed are several issues in the Kirby case, which include the federal jurisdiction in maritime cases, and the expanded application of liability limitations in the Through Bill of lading. This study is expected to contribute in the development of Korean freight forwarding systems by initiating a comparative analysis of the legal environments of the leading countries, suggesting the informative guidelines for further research works.
