A Study on the Judgement Standard of Safe Port

As a the judgement standard of safe port under common law in English, it can largely be divided weather conditions, physical features and political causes of the port. Under common law, that is to say, safety of a port must be decided by reference to the size and draft of the particular ship in question, the physical features of the port named such as the provision of weather reports and other information conditions and the danger of capture or seizure due to political causes in the named port. On the other hand, Korean Commercial Law has no regulations upon the interpretation standard of the safe port. I think that the reason is uniformly difficult to judge whether a particular port is safe or not upon the particular ship. But even if it is difficult to specify the detailed regulations on the safe port, it is necessary to have the minimum provisions upon the concept and judgement standard of safe port considering common law in English
