Discussion on Google Book Search Service in UK -Focused on Fair Dealings-

Google Inc. has provided its publishers with Google Book Search Publisher Program and offered its users Google Book Search Library Project. Google Book Search Publisher Program will not create many copyright issues because it has been related to copyright license between the Google Inc. and its publishers. However, the Google Book Search Library Project is expected to cause some copyright infringement issues. This Article discusses whether the Google Book Search Library Project infringe the copyright on the books sought by its search service in UK. In particular, the Article deals with the Project falls within the fair dealings in UK copyright law. Articles 29 and 30 of Copyright, Designs and Patents Act 1988 in the UK prescribe the fair dealings. According to those provisions, the fair dealings are allowed only for the purpose of research or private study, criticism or review, or current event reporting. However, the Article concludes that it is hard to say that the Project falls within the fair dealing in accordance with articles 29 and 30 of Copyright, Designs and Patents Act 1988 in the UK.
