정신장애인 재범현황과 그에 대한 교정사회복지적 대응방안에 대한 소고

Study on the present situation of recommiting crime by the mentally handicapped and the countermeasures of rectifying social welfare to the situation

우리나라의 장애인범죄현상은 그다지 높지 않은 수준이다. 그러나 1999년부터 2008년까지의 장애인범죄율은 계속 증가하고 있는 상황이다. 더욱이 최근에는 장애인의 범죄경력(재범)이 점차 발전하고 있음을 알 수 있는데, 이는 사회적으로 심각하게 받아들여야 할 것으로 생각된다. 일반적으로 범죄경력이란 어떤 사람이 범하는 범죄의 순차적 연속성을 말하는 것으로, 한 번의 범죄이후 더 이상 범죄를 저지르지 않는 경우도 있을 수 있으며, 여러 개의 범죄경력을 가지는 경우도 있다. 이와 같은 범죄경력의 심각화가 최근에는 장애인에게도 나타나고 있기 때문에 본 연구에서는 장애인의 범죄의 재범화를 살펴보고, 사회복지적 대안을 모색하고자 하였다. 이를 위해 재범에 관한 다양한 학자들의 연구를 배경으로 하여 장애인의 재범현상에 대한 이해를 하였다. 그리고 우리나라 장애인의 범죄처우 및 문제점 등을 살펴보면서 재범을 억제하는데 필요한 개선방안들을 사회복지적 관점에서 검토하고자 하였다.

Our contry's crime phenomena of the mentally handicapped is not in very high level. But from the year 1999 to 2008 crime rate of the handicapped is in continuously increasing situation. In addition, recently we can see that the crime career (recommiting crime) of the handicapped is gradually developing and think that it should be socially seriously accepted. Generally speaking, crime career means progressive continuity of crimes a certain person commits. After committing crime once there are occasions where a person does not commit crime anymore or a person has crime career of many offences. Since the seriousness of crime career like this appears in the handicapped too recently, this treatise is to look into recommiting crime by the handicapped and to seek the countermeasures of social welfafe. To do this, the writer understood the phenomena of recommiting crime by the handicapped with the foundation of various studies of scholars on recommitting crime. And while looking into the treatment of crime of the handicapped and the problems of our country, the writer tried to review the improvement method necessary for retraint of recommitting crime in a view point of social welfare.
