수용자 교육권 보장을 위한 교정교육의 활성화 방안

Study on the Promotive Method of Correction Education to Guarantee Prisoner's Right to be Educated

헌법의 이념적 기초는 인간의 존엄성으로 인간의 존엄성이란 인간다운 삶을 살아갈 권리이며 나아가 복지를 누릴 권리이다. 인간이 인간답게 살아가기 위해서는 교육이 필요한데, 수용자도 인간으로서의 존엄성을 가지며 결핍에 대한 필 요를 요구하고 있으므로 수용자에 대한 교육권 보장은 그 정당성이 인정된다. 그러나 수용자의 교육받을 권리는 일반인들에 비해 불리한 위치에 놓여 있는데 이는 예산 부족, 전문 인력 부족, 시설 및 기자재 부족, 중요성에 대한 인식 부족 등으로 형식적, 비현실적으로 교정 교육이 이루어지고 있기 때문이다. 따라서 교정교육의 중요성에 대한 인식 확산, 충분한 예산 확보, 전문 강사 초빙, 교정교육 시설 및 기자재의 확보, 다양한 프로그램 개발 그리고 성숙한 시민 의식 확산 등으로 수용자들의 교육권 보장을 위하여 노력해야 할 것이다.

Constitutional basic ideology is human dignity that is defined as right to live like a human being and right to enjoy welfare. To live like a human being, a human needs education. As prisoners find it necessary to have human dignity, it is natural for prisoners to have right to be educated. However, prisoner's right to be educated is behind the eight ball. Correctional education passes off formally and by unrealistic because of budget crunch, shortage of professional manpower, lack of equipment and infrastructure, lack of importance about prisoner's education and so on. Therefore, we have to try to guarantee prisoner's right to be educated through spread of awareness about correctional education, enough budget, inviting an expert, securing equipment and establishing infrastructure, development of various program and spreading mature sense of citizenship.
