감옥폐지주의

On Norwegian Prison Abolitionist

이 논문은 감옥폐지주의 운동과 이론이 부재한 우리나라에서 전세계 감옥폐지주의 운동과 사상의 대부격인 토머스 마티센이 노르웨이에서 크롬이라는 감옥폐지주의 운동단체를 설립하여 지금껏 활동해온 사례를 소개하고자 한다. 크롬이 출발할 당시 정치적 격동의 1960년대 후반이라는 시대적 배경, 미국은 베트남 전쟁의 수렁 속에 빠졌으며 반전 시위가 미국은 물론 유럽과 노르웨이에서까지 크게 고조된 상황이었다. 뚜렷이 좌파적인 색채를 띠었다. ‘복지국가’마저도 공격과 비판받았으며, 상당수 계층을 주변부화한다는 이유였다. 이런 맥락에서 감옥 역시 공격과 비판의 대상이 되었다. 크롬은 감옥에 대한 불만, 풀뿌리, 폐지주의, 하나의 과정으로서 정치활동 등에 바탕을 두고 있으며, 활동상은 사흘짜리 학회, 각종세미나, 소식지, 신문기사 언론보도, 크롬관련 도서출간 등으로 이루어지고 있다. 장기적으로 감옥폐지를 지향하며 그러나 단기 감옥개혁도 함께 추구하고 있다. 이 과정에서 감옥폐지주의라는 대안적 공론장을 구축해나가고 있다. 우리나라는 아직 재소자와 가족, 시민인권단체 중심으로 감옥운동은 활발하지만, 감옥폐지주의는 운동이나 이론 차원에서 아직 대두조차 하지 못하고 있다. 이런 맥락에서 크롬을 중심으로 노르웨이에서 마티센이 주도해온 감옥폐지주의 운동과 이론은 우리나라에서도 나름대로 전개되는데 자극제가 될 수 있다.

It discusses on the backgrouds of KROM, principles of activities, way of recruiting staffs, and so on. Political movements of the late '60 such as anti-Vietnam War overwhelmed USA and the European countries, including Norway. The Revolution of 1968 attacked even the welfare state because they believed that it marginalises most of the lower class. Of course, the prison did not escape the criticism and attack from this leftist movements and perspectives. KROM has been based on the complaint on the prison, the grassroots, i.e. the prisoners, the abolitionism, and the political action as a process. It has organised three-days conference and seminars, produced the newsletters and books, and contributed the articles on the prison system to the press. It seeks to abolish the prison system but makes and effort to reform it. It achieves to develop the alternative space to reform and abolish the prison systems in the sphere of the Norwegian penal policies. South Korea has not developed the movements and theories on the prison abolitionism, although so many prisoners, their families and NGOs protests the conditions of prison, unfair treatment from authorities, deliveries of letters, the lower level of human rights, and so on. So it is thought that Norwegian experiences of KROM would lead to stimulate the more fundamental goal of the prison system in South Korea and the attempts to contact with it on the Korean activists to learn the conditions to organise the successful NGOs to reform and abolish the prison system.
