전자선화증권에 관한 CMI 규칙의 재해석에 관한 연구

A Study on Reinterpreting the CMI Rules for Electronic Bills of Lading

최근 선화증권의 위기라 불리는 선화증권이 물품보다 늦게 도착하여 목적지에서 물품의 인도가 늦어지는 상황이 벌어지고 있다. 이러한 문제를 해결하기 위해서 국제기구들은 해상운송장, 수입화물선취보증장 등의 방법들을 도입하였으나, 유통가능한 권리증권으로서의 기능 부재로 만족스럽지 않았다. 국제해사법위원회는 운송계약에서의 종이선화증권의 기능을 대체하기 위해서 1990년에 “전자선화증권에 관한 규칙”을 공표하였다. 비록 CMI 규칙은 운송인에게 추가적인 책임과 비용을 부담시킴으로써 실패하였지만, 종이선화증권의 기능을 전자선화증권으로 대체할 수 있다는 가능성을 보여 주었다. 본 논문은 CMI 전자선화증권에 관한 규칙을 재해석하고 문제점과 해결방안을 모색함으로써 전자선화증권의 도입에 공헌을 하는 것을 목적으로 한다.

Recently, the situation named to as the crisis of bills of lading has occurred in which bills of lading arrived later than the goods, thus result in a delay in delivery of the goods at the place of destination. To solve this problem, international organizations tried to adopt the ways such as Sea Waybill, Letter of Guarantee. But these methods are unsatisfactory because of absence a function of “a negotiable document of title”. The Committee Maritime International published “Rules for Electronic Bills of Lading” in 1990 to substitute the function of the paper bills of lading as the contract of carriage. Although CMI rules failed because of the problems on carrier's additional liabilities and cost, CMI rules was shown the possibility of replacement the functions of paper bills of lading to electronic bills of lading.The purpose of this paper is contribute to the introduction of electronic bills of lading by reinterpreting the CMI rules for electronic bills of lading and the problems and solutions of the CMI rules for electronic bills of lading.
