제도분석틀(IAD)을 활용한 신규등록토지 분쟁 연구

Study on the Dispute about Newly Registered Land using IAD Framework - Focused on Public Surfaces of the Water between Busan and Gyeongsangnam-do -

본 연구의 목적은 신규등록토지를 둘러싼 지방정부간 분쟁사례를 IAD분석의 틀을 적용하여 분석.평가하고, 그 결과를 토대로 분쟁해결의 합리적 방향을 제시하는 것이었다. 연구대상은 지방정부간 공유수면매립지 분쟁사례로 한정하였고, 시간적 범위는 1990년부터 현재까지로 공간적 범위는 부산광역시와 경상남도로 내용적 범위는 신규등록토지 분쟁의 예방 및 해결방안을 제시하는 것으로 설정하였다. 연구의 접근방법은 행정적 접근방법과 법률적 접근방법에 기초하였고, 조사방법은 문헌조사법과 사례조사법, 인터넷조사법을 병행하였으며, 분석방법은 제도분석의 틀(IAD)을 활용한 기술적(記述的) 분석법을 사용하였다. 연구결과, 공유수면매립지와 관련한 분쟁의 영향요인으로는 법제도적 요인과 환경적 요인이 도출되었고, 도출된 영향요인을 토대로 분쟁해결의 합리적 방향을 제시하였다. 먼저 법.제도적 측면에서는 지적본위의 신규등록토지 분쟁해결 체계구축과 해상경계선의 합리적 획정을 제시하였으며, 환경적 측면에서는 경제적 유인구조의 마련과, 협의문화정착을 위한 분쟁교육의 실시를 주장하였다.

The purpose of this study is to analyze and evaluate the disputes about the newly registered land between the local governments using Institutional Analysis and Development (IAD) Framework, and to propose a reasonable solution. The target of the study was limited to the disputes about the newly registered land between the local governments, where as the time scope was limited from 1990 to the present. The spatial scope was set as Busan Metropolitan City and Gyeongsangnam-do, and the contents were limited to preventing the disputes about the newly registered land and to proposing a solution. An administrative approach and legal approach methods were used. As for the research, literature, case studies, internet research methods were used. As for the analysis, a descriptive analysis method using IAD framework was used. As a result of the study, it was found that the disputes about public surfaces of the water are affected by the legal and institutional factors and environmental factors. This study proposed a resealable solution for the disputes based on the affecting factors. First, in terms of institutional aspect, a system must be established for resolving the disputes about the newly registered land based on cadastre, and the marine border must be reasonably demarcated. In terms of environmental aspect, an economically incentive structure must be prepared, and dispute educations must be provided for the settlement of discussion culture.
