SCAN(Scientific Content Analysis ; 과학적 내용분석)은 미국 등 여러 나라의 형사사법기관에서 사용되고 있는 진술 분석 기법 중의 하나로서 진술의 내용과 구조를 분석하여 진술의 신빙성을 평가한다. 본 연구는 SCAN을 통하나 진술의 신빙성 평가가 거짓 탐지 업무에 보조적 도구로 활용될 수 있는지를 탐색하고자 현장연구를 수행하였다. 본 연구에서는 국방부조사본부 과학수사연구소 거짓말탐지검사실에서 폴리그라프 검사를 받은 45명의 피검자를 대상으로 폴리그라프 검사를 받기 전에 사건에 대한 진술서를 작성케 하고 이를 SCAN을 통한 진술분석을 하였고 그 결과를 피검자의 폴리그라프 검사 결과와 비교하였다. 연구 결과, 45개의 진술서에 대한 진술 분석 결과와 폴리그라프 검사 결과 간의 일치율 분석에서 폴리그라프 검사 결과 거짓 아님인 진술자의 71.4%가 진술분석 결과 거짓 아님 판정을 받았고, 폴리그라프 검사 결과 거짓으로 평가된 진술자의 80%가 진술분석 결과 거짓으로 판정 받았다. 즉, 진술분석의 결과가 거짓 아님의 평가보다 거짓인 평가가 폴리그라프 검사 결과와 더 일치하는 것으로 나타났으며, 전체적으로 진술분석 결과와 폴리그라프 검사 결과 간에 평균 75.7%의 일치율을 보였다. 본 연구의 결과를 통해, 거짓 탐지 업무에서 진술분석을 활용하는 것이 보다 효율적이고 보완적인 탐지를 가능케 할 수 있었다. 끝으로 수사실무에서 SCAN을 활용하는 문제에 대해서 논의하였다.
SCAN(Scientific Content Analysis) is one of the statement analysis technique being used in the criminal justice system in many countries including the U.S.. SCAN analyzes contents and structure of statements and evaluates their credibility. A field study was carried out to test whether or not SCAN can be used as a supplementary lie detection measure to polygraph test. In this study, 45 people underwent a polygraph test at Scientific Investigation Laboratory for criminal cases. Before the polygraph test, testee were analyzed using the SCAN criteria for credibility and the results were compared with polygraph test results. 71.4% of participants who were decided to be truthful by the polygraph test were judged to be truthful by SCAN. And 80% of participants who were decided to be not truthful were judged to be untruthful by SCAN. On the average, 75.7% average concordance rate was obtained between the results of statement analysis and polygraph test. The result of this study suggest some possibility of using statement analysis as a supplementary measure for lie detection. Finally some limitations of applying statement analysis technique such as SCAN to criminal investigation were discussed.
