A study on the internet real name system

인터넷 본인확인제에 대한 논의는 표현의 자유보장과 규범확립, 피해구제라는 포기할 수 없는 두 가치를 어떻게 하면 동시에 충족시킬 수 있을 것인가 하는 문제상황을 전제로 전개되는 것이다. 어느 쪽도 소홀히 할 수 없지만 자유의 보장과 규범의 요구라는 갈등관계를 내포하고 있기 때문에 일면적으로 해결할 수 있는 성질의 문제는 아니다. 사이버 공간에서 일어나는 부정적 현상을 직접 규율하기 위해 본인확인제가 도입되었지만 반드시 국가가 일률적으로 규제하는 방안이 타당하다고 볼 수는 없다. 익명성 조건에 대하여 당사자가 자율적으로 선택할 수 있도록 해도 사이버 공간 상에서 온라인서비스제공자의 법적 책임과 효과적인 피해구제절차 등을 정비함으로써 자유의 보장과 인격권 보장, 피해구제 등의 요구를 조화롭게 충족시킬 수 있을 것이라고 본다.

The discussion about the internet real name system is developed on the assumption that how the two inalienable values – securing the freedom of expression and the establishment of the norm can be achieved at the same time. Although both of them must not be neglected, it is impossible to solve in a one-sided way because it contains the difficulties between securing the freedom and the demand of norm. The internet real name system is adopted, in order to regulate negative incidents which occur in cyber space. However, it doesn't have to be regulated by the state necessarily. Even though the parties concerned choose the condition of anonymity autonomously, the task of harmonizing the demands of securing the freedom, personal rights, and relieving the damages will be satisfied by arranging the legal system for legal responsibilities of online service providers and procedures of relieving damages effectively.
