성년후견제도의 사회보장적 법적 방안에 관한 고찰

The problems legal and some improvements of the social welfare guardianship of the senior citizen

우리나라에서 성년이지만 지적장애자, 정신장애자, 고령자 등인 경우 이들을 배려하기 위한 법적 제도는 아직 미비한 상태에 있다. 민법상 한정치산제도, 금치산제도, 후견인제도 등이 있지만 이들 제도를 규정하고 있는 규정내용들이 아 주 간단하기 때문에 다양한 종류의 지적장애자, 정신장애자 및 고령자에게 적합하지 않는 것이 지적되고 있다. 또한 무능력자로 인정되는 자의 자기결정권을 제한하고 지나치게 획일적으로 시행되어 한정치산자 등에게 그들의 잔존능력을 무 시하여 재활의 기회를 배제하는 결과를 초래할 뿐만 아니라 공시방법상의 문제로 본인 등에게 사회적 불명예를 초래하기 때문에 동 제도를 기피하고 있다. 우리 민법의 행위 무능력자제도는 자기결정권의 존중, 인간존엄성의 보장이라는 측면에서 매우 낙후된 제도임에 따라 이러한 문제점들을 해결하고 고령사회의 진입으로 인한 고령자에 대한 배려와 장애인의 복지증진 및 사회적 안전망을 구축하고, 인권을 보호하기위하여 성년후견제도를 도입해야한다는 당위성이 증가하고 있다. 이러한 사회보장적 관점에서 기존 의 행위능력․후견제도를 현재 정신적 제약을 가지고 있는 사람은 물론 미래에 정신적 능력이 약해질 상황에 대비하여 후견제도를 이용하고자 하는 사람들의 재산행위뿐만 아니라 치료, 요양 등 복리에 관한 폭넓은 도움을 받을 수 있는 성년후견제를 확대․개편하는 법률안이 국회와 정부 등에 의해서 국회에 제출되어 있다. 따라서 본 연구는 후견이 필요한 이들의 인권을 보장하고 돌봄의 필요를 충족시킬 수 있는 성년후견제도의 법적 과제와 문제점 및 사회보장분야에 대한 지원방안을 마련하는 데 있다.

While Korea has become the aged society, its birth rate has drastically decreased as well. As the society pays great attention to the situation of the aged society, people in Korea are also interested in reasons, development, counter - measures, etc. Although no country has entered into the high level of the aged society yet, most of industrialized countries have prepared and developed for few decades some policies in terms of population, labor market, social welfare, economy, etc. in order to prevent to become an aged society. However, Korea has recently prepared such counter-measures. Under such circumstances, this paper aims to review the legal system and problems to prevent and aged society and suggest some improvements. Among possible problems in the aged society, this paper will research the issues concerning health welfare, guardianship. It will at first review the spirit of legislation for the aged society in light of some discussions in international organizations as well as the related laws and regulations in Korea and other jurisdictions. It will search to review to introduce the guardianship in which any senior citizen who has insufficint knowledge and decision - making ability in the management of asset and its body can be supported by guardian
