A Study on the Features of the Incoterms 2010 Rules

Incotermsⓡ 2010 were launched in mid-September 2010 and will come into effect on 1 January 2011. The new rules reflect the changes in international trade since the last version of the rules was published in 2000. The most significant change is the addition of two new rules: Delivered at Terminal (DAT) and Delivered at Place (DAP). In turn, the ICC has abolished four Incoterms rules (DAF, DES, DEQ and DDP). The new incoterms are also aimed at being more user friendly, in particular with the use of guidance notes at the start of each rule, providing users with more information and directing them to the correct rule. As has always been the case, Incoterms 2010 will only apply with force or by law if the parties voluntarily contract on the basis of these terms. Given the January 1, 2011 effective date of the new Incoterms, it will be important for traders who wish to keep on using the previous version of the Incoterms to provide a specification to that effect.
