정치의 사법화의 세 가지 유형

Three Types of Judicialization of Politics - A Comparative Constitutional Case Study focusing on the U.S. Cases -

2004년 헌법재판소의 두 결정례는 헌법재판소의 권한 및 역할 수행에 대한 시선의 변화를 유도하였다. 이전부터 꾸준히 정치문제에 대하여 중요한 발언을 하였던 헌법재판소는 두 판례에서 정치적인 색채가 강한 국가적 논제를 종국적으로 해결하는 모습을 보여주었고, 정치의 사법화 현상을 주도했다고 평가되었다. 본 연구는 비교헌법적 연구를 통하여 정치의 사법화 현상의 다양한 양태를 규명하여 정치의 사법화에 대한 연구가 보다 엄밀하게 전개될 수 있는 틀을 제공하는데 목적을 두었다. 특히 연방대법원에 의한 정치문제의 관여가 빈번하고 정치의 사법화에 대한 연구가 진작부터 활발하게 전개되어 온 미국에서의 논의를 중심으로 정치의 사법화 현상을 세 가지 유형으로 정리해 보았다. 그 유형의 첫째로는 사법심사의 정착에 따라 기본권 보호의 측면에서 정치문제가 사법에 의해 해결되는 현상을 들었고, 둘째로는 정당의 활동이나 선거 과정 혹은 선거의 결과 등에 대한 사법부의 적극적 개입을 들었으며, 마지막으로는 국가의 구성요소를 획정하고 그 정체성을 확인하며 국가의 과거와 미래를 규정하는 사안에 사법부가 적극적으로 관여하는 것을 들었다. 이처럼 정치의 사법화에 대한 논의를 함에 있어서는 다양한 양상의 현상이 존재함을 인식하면서 구체적인 사례가 어떠한 유형에 속하는지 판단하여 논의를 전개하는 것이 논의의 엄밀성을 추구하고 오류를 피하기 위하여 필요할 것이다.

Two cases of the Constitutional Court of Korea in 2004 has caused a new academic point of view regarding its role and power. As the Court finalized controversial cases of political nature, legal academia commented that the Court started to lead judicialization of politics. The goal of this study is to offer an academic frame for a close examination of judicialization of politics by showing various types of judicialization of politics through a comparative constitutional case study. In this study, by researching the constitutional cases of the U.S. in which the Supreme Court has often intervened various political cases, I categorize judicialization of politics into three types. The first type is a judcialization of politics in which a judicial power reviews public policies by using rights jurisprudence. The second type is a judcialization of politics in which a judicial power affirmatively intervenes the process and result of election(voting). The final type is a judcialization of politics in which a judicial power solves cases of mega-politics or creates the identity and fundamental factors of a nation.
