미국의 아동대상 성범죄 관련 법률에 대한 입법론적 검토

미국에서 아동대상 성범죄가 본격적으로 사회문제화 되기 시작한 1990년대 이후 국가에 부여된 정책적 우선순위는 아동성범죄로부터 아동을 보호하는 것이었을 정도로, 아동대상 성범죄대책은 연방과 주의 입법정책 중에서 높은 우선순위를 차지하고 있다. 워싱턴주는 주차원에서는 최초로 1990년에 성범죄자에 대한 관리, 감독 및 치료를 규정한 종합적인 법률인 ‘공동체보호법’을 만들었고, 1994년에 연방의회는 ‘웨터링 아동 및 성범죄자 등록법’을 입법하였다. 뉴저지주는 1994년에 메건법을 제정하였고, 1996년에 연방의회는 연방차원의 메건법을 입법하였다. 2005년에 플로리다주에서는 제시카 런스포드법이 주법으로 입법되었으며, 다른 주들도 이와 유사한 내용의 입법을 하였다. 이후 2006년에 연방의회는‘아담 월시 아동보호 및 안전법’을 입법하였는데, 이는 성범죄자의 감시와 관리에 관한 가장 종합적인 법률의 하나로서 평가된다. 미국의 성범죄 예방 및 재발방지를 위한 법률이 내용으로 하는 주요 정책수단으로는 성범죄자 등록 및 공개, 민사적 감금치료, 접근제한, 전자감시, 형량강화, 주거제한, 성폭력범에 대한 강제적 화학적 거세, 강제적인 후천성면역결핍증 검사 등이 있다. 이러한 성범죄대책을 위한 정책수단 중에는 성범죄자의 등록과 공개를 주 내용으로 하는 인텐시브한 지역사회의 감시가 가장 폭넓은 지지를 받고 있다.

Sex offenders arouse disgust and anger in Korea as well as in USA. Especially the sex offenses that cause most public arger are sex crimes against children and youth who lack the capacity to defend themselves from the sexual aggression of exploitative adults. The public outrage motivated to make a series of sex offender laws in USA. Since the 1990s, "memorial laws", enacted after kidnapping, sexual assault, murdering of children, are proliferated in USA. They are Community Protection Act, Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act, Megan's Law, Pam Lychner Sexual Offender Tracking and Identification Act, The Campus Sex Crimes Prevention Act, Jessica Lunsford Act, Adam Walsh Child Protection and Safety Act, etc. Adam Walsh Child Protection & Safety Act of 2006 is the most comprehensive and far-reaching set of sex offender laws that the federal congress has ever passed. This legislation have focused on protecting the children from the sexually dangerous offenders. According to the studies and the data, sex offenders repeat their crimes than any other offenses. The sex offender laws have usually following forms of major sex offender policies : sex offender registration, community notification, civil commitment, proximity restrictions, GPS tracking and monitoring, chemical and surgical castration and death penalty.
