녹색성장을 위한 개별 부동산법제의 개선방안

A Few Suggestions to Realize Green Growth in Land Use Policy

현행 부동산법제는 각 법률의 제정목적에 따라서 개발 혹은 보전이 이루어지고 있으나 지속가능성의 법이념에 비추어 볼 때 내용이 통일적이지 못하다. 지속가능발전 개념은 비교적 최근에 도입된 개념이므로 아직은 모든 부동산이용질서에 영향을 미칠만한 시간은 없었던 것으로 파악된다. 중요한 부동산이용관계법제에서 나타나는 지속가능성 혹은 유사 개념을 파악하고 이를 다른 법제와의 비교를 통하여 정비하는 방안을 모색하였다. 종래 국토이용질서를 형성해 온 국토이용 및 계획관련 법제가 어떻게 정비되어야 하는지를 아울러 살펴보기로 한다. 수도권정비법 및 국토의 계획과 이용에 관한 법 등의 법률이 상호간에 그 목적과 수단을 달리하고 있는 결과 현실과 법목적 사이에 괴리가 발생하고 있다. 녹색성장은 지속가능발전의 현정부적 표현이라고 생각한다. 기후변화를 방지하기 위한 이산화탄소의 배출억제, 환경오염 방지, 국민의 삶의 질의 확보 등이 모두 이 녹색성장이라는 말 속에 함축된다고 본다. 녹색성장을 위한 부동산법제는 지속가능발전의 세 축인 경제발전, 생태보전 그리고 사회통합이 형성하는 균형점 위에서 형성된다고 할 것이다. 그간 좁은 국토를 최대한 효율적으로 사용하기 위한 각종의 제도를 만들면서 상당한 정도의 발전을 이룩하였다. 그런데 성장 위주의 부동산 정책은 기후환경변화와 환경파괴 등에 직면하여 질적인 변화를 요청받고 있다. 이를 잘 대변하는 이념이 지속가능발전이라고 생각된다. 지속가능발전의 특징을 다른 말로 표현하면 행위의 합리성의 증대이자 보다 거시적인 관점의 도입이다. 그 수단으로 각종의 지표 및 계획 그리고 계산이 사용된다. 그리고 이를 기초로 한 환경보전 및 사회통합이다. 다른 분야보다도 특히 부동산의 이용규율법제에서는 이 원칙이 보다 구체화되어 적용되어야 하는 시점이다.

The concept of sustainable development in legal system marked a turning point of legal theory. Legislation and interpretation of acts should consider the interest of future generations as well as currentgeneration. For the use of real assets as basis of living and industry sustainability is first to come into mind. Development of land raised many problems as urban concentration, disorder of planning, pollution and disaster so far. Green growth of present Lee government can be regarded as an other expression of sustainable development. It contains such policies as avoidance of CO2 emission, protection of environment, keeping the quality of life. Land use for green growth can be achieved on the balance of economic development, environment protection and social unification, which are the three elements of sustainable development. In economic growth of Korea, effective use of land has played important role. But confronting global climate change and destruction of eco-system a radical change of land use system is in need. Central concept for this change should be sustainable development or green growth. In other word, reasonableness and a long term point of view should be introduced in land policy. The instruments are various indexes, planning, assessment and calculations. Regarding that land is indispensable resource for human existence, reasonable development policy is an urgent task for us.
