The First Korean Sentencing Guidelines and Sentencing toward Robbers with Injuring Victims

본 연구는 강도상해범죄의 양형에 관한 경험적 연구이다. 특히, 본 연구는 2009년 7월 1일부터 적용되기 시작한 제1기 양형기준의 적용현황을 분석하기 위한 것이다. 자료는 2009년 7월 1일 이후 공소제기 되어 2010년 9월 30일까지 1심 판결이 선고된 강도상해범죄에 대한 양형데이터이며, 이 자료는대검찰청의 사건처리정보시스템(PGS)으로부터 획득되었다. 분석결과는 강도상해범죄의 두 가지 세부 형종 및 형량 기준별 분포특성, 기준의 부합률, 양형인자들의 적용빈도와 개별적ㆍ상대적 영향력 등으로 나누어 제시된다. 양형인자들의 상대적 영향력을 평가하기 위한 회귀분석의 결과는 특별감경인자인 ‘경미한 상해ㆍ과실상해,’ ‘범행가담참작사유 있음,’ ‘체포ㆍ면탈위한 폭행ㆍ협박,’ ‘피해자의 처벌불원,’ 일반감경인자인 ‘소극가담,’ ‘심신미약(본인책임 있음),’ 특별가중인자인 ‘취약한 피해자,’ ‘중한 상해,’ ‘피지휘자에 대한 교사,’ 그리고 일반가중인자인 ‘계획적 범행,’ ‘범죄전력’이 양형에 유의미한 영향을 미치는 것으로 나타났다. 결론에서는 이러한 분석에 기초하여 현행 양형기준에 대한 몇 가지 개선방안이 제시된다.

This is an empirical study on sentencing toward robbers with injuring victims. Especially, this study is to analyze the status quo of application of the first Korean sentencing guidelines. The data are composed of 364 robber cases with injuring victims which were sentenced by the first stage courts nationwide between July 1st, 2009 and September 30th, 2010. The data come from the Prosecutorial Guideline System of the Korean Supreme Prosecutors' Office. The results are presented about the distribution features of sentence by the two subtypes of robber cases(with injuring victims), the correspondence rate of the guideline, the frequencies that specific sentencing factors were adopted, and the individual and relative influences of the factors, etc. The results of multiple regression analyses show that the special sentencing factors prescribed by the guideline such as minor or negligent injuring, existence of extenuating circumstances, assault/threat to avoid arrest, victim's intention for punishment, vulnerability of victims, serious injuring, abetting persons with command and general sentencing factors such as inactive participation, mentally and physically weak conditions (self-responsible), planned crime, serious criminal records were significant in predicting the length of sentence among robbers with injuring victims. Finally, we propose some reform measures for the first Korean sentencing guidelines based on the present analyses.
