정치의 사법화와 헌법재판의 정치화

Judicialization of Politics and Politicization of Constitutional Adjudication - Universal Trends and Korean Characteristics -

이 글은 우리 헌법재판제도 및 그에 관한 담론에 대한 비교헌법학적 고찰이다. 특히 최근 헌법재판에 대한 논의를 이끌고 있는 외국학자들의 이론에 비추어 우리 헌법재판을 이해하는 것의 효용과 한계를 가늠해보려는 시도다. 입헌주의의 역사적인 발달과정과 관련하여 살펴볼 때, 우리 헌법재판제도는 현재 세계적으로 확산되고 있는 “재판중심적” 입헌주의의 한 예로 볼 수 있음을 논하고, 그러한 입헌주의 하에서 정치의 사법화는 어느 정도 불가피함을 살피고자 한다. 이론적으로는 허쉴(Hirschl)이 제시하는 사법화의 세 가지 층위와 페레존(Ferejohn)이 거론하는 사법화를 조장하는 두 가지 요인에 비추어서 우리 헌법재판소의 현주소를 파악해보고자 한다. 다음으로, 미국과 유럽의 헌법재판제도의 차이에 관한 로젠펠드(Rosenfeld)의 설명을 우리나라에 적용하였을 때 나타나는 역설적인 현상을 소개함으로써 우리 헌법재판제도의 특이성을 도출해 보고자 한다. 우리 헌법재판제도의 몇 가지 특징으로 말미암아 헌법재판의 정치화가 더욱 심하게 나타나는 환경이 조성되어 있음을 밝힌다. 이로 인하여 외견상 유럽형 헌법재판제도를 취하고 있음에도 불구하고 미국의 연방대법원을 둘러싼 사법의 정치화 담론과 유사한 현상이 나타남을 지적하고자 한다.

This article is an analysis of the various discourse surrounding Korean constitutional adjudication system from a comparative perspective. It seeks to understand the Korean system by reference to leading theories on the worldwide expansion of constitutional adjudication. It shows that Korea may be seen as an instance of the global spread of “court-centered” constitutionalism and that judicialization of politics is an inevitable phenomenon in that process. It analyzes the Korean situation in light of Hirschl’s three levels of judicialization of politics and Ferejohn’s two leading causes of judicialization. Next, it introduces a paradox that appears when we apply to the Korean scene Rosenfeld’s explanation of the difference between European and American systems of constitutional adjudication. It then provides an explanation by showing that the Korean Constitutional Court is situated in an institutional matrix which causes it to attract charges of undue politicization, in manner similar to the U.S. Supreme Court. Despite its European pedigree, the Korean Court is more akin to the American model regarding politicization of courts.
