노인 학대의 인권적 접근

노인 학대는 인권에 대한 침해이다. 이는 노인 학대가 일부 사회에서만 발생하는 국한된 문제가 아니라 대부분 국가나 문화들에서 존재하는 보편적인 사회적 이슈로 인식되는 것과 관련이 있다. 하지만, 노인 학대를 인권적 관점에서 파악하려는 학문적 노력은 아직 미미한 수준에 머물고 있는 실정이다. 이 논문의 목적은 노인 학대를 인권적 관점에서 고찰하여 문제 예방과 해결을 위한 이론적 및 실천적 접근 방법을 제시하는 데 있다. 이 이론적 연구의 주된 논의는 노인학대를 3세대 인권 개념을 통해 체계적으로 분석한 점에 있다. 전통적으로 분류된 노인 학대 유형을 현대적 인권 개념에 접목시켜 권리와 학대의 관계를 구체적으로 검토하였다. 이와 같은 노인 학대에 대한 인권적 접근방법은 사회복지를 비롯한 휴먼 서비스 분야에서 효과적인 이론적 및 실천적 전략들을 수립하는 데 도움을 준다. 이 논문에서는 임파워먼트와 가족적 정의 중심의 전략들이 논의되었다. 이들 전략들은 노인학대를 다루는 전문가들이 노인 학대가 인권적 침해라는 기본적 관점을 바탕으로 사회복지 실천과 정책을 집행할 수 있는 효율적인 근거를 제공해준다.

Not only is elder abuse and neglect a threat to the health and welfare of older people, but it is also a violation of their human rights and dignity. The problem is universal and growing as it occurs in every culture. The purpose of this article is to discuss the issue of elder mistreatment with reference to human rights and dignity. Recognising elder mistreatment as the issue associated with human rights means that every nation has the responsibility to protect the rights and dignity of older people from any harm and violence. The concept of three generations of human rights is critically used to analyse elder abuse and neglect into three different categories. An empowerment perspective is considered as an important approach to tackling the problem of elder mistreatment. A family justice perspective is also presented as an effective tool to develop appropriate strategies for preventing and responding to elder abuse and neglect in both domestic and institutional settings.
